With the "nuclear option" in place, President Barack Obama needs only 51 votes to see his executive and judicial nominations brought to a vote. Liberals are seizing the opportunity, pushing Obama to nominate people with a left-of-center ideology, The Hill reports.

Senate Democrats invoked the "nuclear option" on Nov. 21, changing the rule that 60 votes were needed to bring judicial or executive nominees to the Senate floor for a confirmation vote. With only 55 members on their side, Democrats had been unable to prevent Republican filibusters.

"Before, we weren’t trying to push people with a labor backgrounds because we knew they would never have been confirmable," a senior labor official told The Hill. "That bar has been removed. You’ll see considerable interest in seeing more progressive people appointed to positions."

The official said "a couple" of potential nominees are currently being pushed, but would not tell The Hill who they were. "There are some assistant secretary positions," the official said.

The union and other liberal groups are trying to keep their list of hopefuls secret to avoid having Republicans mount a successful pushback, The Hill reported. They need sway only five Democrats to thwart a nomination.

Two members of the Commodity Futures Trading Commission and one on the Federal Reserve Board of Governors are up for appointment. Liberals hope to see them given to people who are not overly friendly to Wall Street.

They also are hopeful of having judicial posts filled with liberals. Three vacancies on the influential D.C. Circuit were being held up by a Republican filibuster, which spurred Democrats to use the "nuclear option." The three seats would give the current court, split evenly with four conservatives and four liberals, a decidedly leftward tilt.

The nuclear option does not apply to Supreme Court nominations.

The Obama administration has said the government’s troubled HealthCare.gov website will function smoothly by the end of Saturday.

Those paid to help enroll Americans in Obamacare remain doubtful. From Florida to Alaska, the “navigators” designated to sign people up for insurance under the  healthcare overhaul say the online insurance exchange has improved since its Oct. 1 debut, but outages and errors continue to prevent many from using it to buy their coverage.
The site is “kind of hit and miss,” said Karen Basha Egozi of the Epilepsy Foundation of Florida, a U.S. designated navigator. “There have definitely been more hits lately than in the past. But I know there are cases where people still get locked out when they try to purchase a plan.”
Tyann Boling, chief operating officer of Enroll Alaska, a unit of Anchorage-based Northrim Benefits Group LLC, said she now rates the site a four out of 10, with 10 being fully functional. “It’s got a long ways to go,” she said.
HealthCare.gov, which serves 36 states including Florida and Alaska, was designed to help uninsured Americans buy new health plans by March 31, as required under the 2010 Patient Protection and Affordable Care Act. Delays and software problems, though, have plagued the site since its rollout, giving support to the law’s harshest critics.
Weekend Fixes
Enroll Alaska has signed up 52 people in health plans out of about 2,200 who have requested help since the site opened. Boling said she is mostly successful on the site with simple cases, like a single adult making a set income. For uncommon financial situations, “the website is not able to function at the capacity yet that capture the complications of people’s lives,” she said.
On a Nov. 27 conference call with reporters, Julie Bataille, a spokeswoman for the Centers for Medicare and Medicaid Services, reiterated the administration’s pledge to have the site working smoothly for “the vast majority of users” by Dec. 1. Technicians working on the site will continue making repairs through the weekend, she said.
The government has added storage capacity to the data center and boosted processing power so it should be able to handle 800,000 visits a day and 50,000 users simultaneously, according to Bataille. Still, she said there will likely continue to be unexpected outages, periods of slowness and times when traffic is heavier than the site can handle.
Obama’s Legacy
President Barack Obama said the health-care law will “be a legacy I am extraordinarily proud of,” during an interview with ABC News’ Barbara Walters airing today on “20/20.”
“Obviously my most recent concern has been that my website’s not working,” Obama said, according to a summary of the interview by ABC News. “We’re evaluating why it is exactly that I didn’t know soon enough that [it] wasn’t going to work the way it needed to.”
Recent fixes have made it possible for most consumers to create an account and calculate how much their insurance will cost, according to insurance brokers and non-profit groups helping people enroll. The breakdown often comes at the final step of purchasing a plan, they said.
That’s caused some consumers to give up on the federal exchange with less than a month left for them to buy a plan that will put their coverage in effect on Jan. 1. Increasingly, people are bypassing the federal site and turning directly to insurers, even though that means they can’t get immediate access to U.S. subsidies, said Raymond Magnuson, owner of Magnuson & Associates, a Tucson, Arizona-based insurance broker.
‘Breaking Point’
“This week has become the breaking point,” Magnuson said by telephone. “I have several clients this week that have said exactly that: ‘I give up. I don’t care what the federal subsidy is. Enroll me in a plan. I’ll pay the premium.’”
In those instances, he said, they’re guaranteed coverage for Jan. 1, “but they’re giving up, in some cases, hundreds if not thousands of dollars in federal subsidies because of it.”
Those buying directly through an insurer website would still have to go through healthcare.gov to find out if they qualify for a subsidy, federal officials have said. If they’re applying with the insurer by telephone, they can apply for a subsidy separately through the federal site and have it applied to their plan. The payment then is sent directly to the insurer.
Seeking a Subsidy
While accessing the site may be easier as the result of recent software fixes, using it to figure out the actual cost of a plan can be problematic, said John Foley, supervising attorney for the Legal Aid Society of Palm Beach County, a navigator group in Florida.
Some of the data provided on consumer subsidies has turned out to be incorrect in individual cases so people may be charged more or less than they thought. There’s no consistency, he said.
The Legal Aid Society has only managed to sign up 10 to 15 people out of “hundreds” who have come to the organization for help, according to Foley. Even those successes are questionable, he said, because the group hasn’t yet heard that anyone has received notices from their insurers confirming enrollment.
“It’s slow going,” Foley said.
Lisa Hamler-Fugitt, executive director for the Ohio Association of Foodbanks, a navigator group, is telling people to log on in the evening after peak hours, recommending paper applications when people get frustrated and the call center, if necessary.
‘Buy it Month’
Healthcare.gov “is improving, literally week-over-week and day-over-day,” Hamler-Fugitt said. “October was homework month, November is window-shopping month. So we certainly hope December becomes ‘let’s buy it’ month.”
In the meantime, navigators are trying to keep consumers calm.
“The message we’re giving people is be patient, that yeah, whenever you have something big, it takes awhile,” said Sue Berkowitz, director of the South Carolina Appleseed Legal Justice Center. “But there’s still time, and you can make this happen.”

Thanksgiving Wish--Obama Wants Higher Ratings. What Will He Do To Make Them Better?

Obama Approval Numbers Show Even His Home State Is Abandoning Him

Obama Approval Numbers Show Even His Home State Is Abandoning Him

Barack Obama didn’t have a cheery Thanksgiving as his approval numbers plummeted in two states that normally support the President. Approval numbers in Obama’s home state of Illinois dropped seven points in the last year and are now down to 50 percent, while a Qunnipiac University poll left him with a 34 percent approval rating in the swing state of Ohio.
Although Obama maintains a 92 percent approval rating with African-Americans in Illinois, his numbers in the state have dropped significantly among women and Hispanics. The sharp decline in approval is particularly startling for the Obama administration because he defeated Mitt Romney by 17 points in Illinois during the last election.
Obama beat Romney by four points in Ohio, but it’s unlikely he’d be doing that in 2014 if his latest numbers in that state are any indication. He had 83 percent approval among African-American voters, but just 30 percent of men, 38 percent of women and 23 percent of white voters.
The Quinnipiac University poll shows that 54 percent of Americans disapprove of the job Obama is doing overall, compared to 39 percent who approve. Polling institute director Tim Malloy confirmed that “President Obama’s job approval rating has fallen to the level of former President George H.W. Bush at the same period of his Presidency.” Ratings from male and female voters from all age and economic backgrounds have shown higher disapproval ratings than approval ratings.
Much of Obama’s recent disapproval stems from the difficulties regarding the rollout of ObamaCare. Although the President acknowledged that “we fumbled the rollout on this health care law,” he insisted that the Affordable Health Care act website has “gotten a lot better over the last few weeks.” The White House has said they hope to fix all the website glitches by the end of the year, but that appears increasingly unlikely.

What Effect Will The High Levels Of Un and Under Employment Have On The US?

The following post is by TDV contributor, Wendy McElroy]
Unemployment will be a global tipping point in 2014, and America will tip as well. Europe is already panicking about the likelihood of young people rioting in the streets next summer. The 17-nation Eurozone is predicting severe riots due to soaring unemployment, especially among the young. In September, the Eurozone's general unemployment rate was 12.2%; the rate for young workers was 24.1%. According to the Organization for Economic Cooperation and Development, youth unemployment is nearly 60% in Greece, 55% in Spain and 40 percent in Italy and Portugal.
Last month, violence broke out between police and tens of thousands of protesters who marched in Rome against unemployment and austerity; the French held similar mass rallies last month as well. Greece and Spain seem to have been protesting for most of 2013.
America is widely touted as being the exception in unemployment. But, then, America lies unabashedly about its statistics.
The Bureau of Labor Statistics (BLS) compiles the United States' unemployment statistics every month. It looks at six categories of different data, that are called U-1 to U-6. U-3 counts how many people were unemployed but were actively looking for work during the past month; this is the official unemployment rate that is broadcast by the media. By contrast, U-6 counts the unemployed and underemployed who are excluded from the U-3 data. For example, U-6 classifies people who have unsuccessfully looked for a job in the last year as “not participating in the labor force” rather than as unemployed. U-6 also includes part-time workers who need more employment in order to live, but the number of these workers is dwarfed by the number of long-term unemployed. (“Long-term employment” is defined as lasting 27 weeks or more).
The data included in the categories increase as the numbers ascend; the categories are defined as follows:
  • U-3 Total unemployed, as a percent of the civilian labor force
  • U-4 Total unemployed plus discouraged workers
  • U-5 Total unemployed, plus discouraged workers, plus all other persons marginally attached to the labor force
  • U-6 Total unemployed, plus all persons marginally attached to the labor force, plus total employed part time for economic reasons
What is America's real unemployment rate? According to U-3 for October 2013, 11.3 million people were officially unemployed. BLS adds that 91,541,000 working age people did not participate in the labor force. If these numbers are added together, there are 102 million working age Americans who are either unemployed or not in the labor force for reasons that are not clear; for example, they could be retired. The non-working population represents 37.2% of working age people.
(Note: it is not known how the federal furlough of employees during the October shutdown affected the data, if at all. The furloughed employees seem to have been counted as both unemployed and working because they eventually received full payment for the time off.)
The unemployment rate reflected by the last four categories of BLS data break down as follows:
  • U-3 = 7.3%
  • U-4 = 7.8%
  • U-5 = 8.6%
  • U-6 = 13.8%
The American media used the U-3 numbers and reported the unemployment rate for October to be 7.3%, which is about 1/2 of the more realistic U-6 total. The media also glossed over U-3 figures that were alarming. For example, the official rate for teen unemployment (16 to 19 years old) stood at 22.2%; black unemployment is 13.1%
And, then, there were the outright media lies. For example, the New York Times reported on November 17, “[T] he economy is improving, if slowly. Employers are now adding jobs at a pace of around 200,000 a month, and the unemployment rate has dropped to to 7.3 percent.” [Emphasis added.] Actually, the September rate was 7.2%, making the October rate an increase in unemployment, not a drop. But the NYT could not claim “the economy is improving” without data that reflected improvement.
One aspect of the BLS data is particularly alarming. In the month of October alone, 923,000 new people became “non-participants” in the labor force. Given the job killing impact of Obamacare, it is reasonable to assume that the rate of growth for non-participants will hold steady in the foreseeable future. If so, then, by 2017, there will be more working age people who are not in the workforce than there are ones holding jobs in America.
Other factors make American unemployment more explosive. For example, an estimated 1.3 million long-term unemployed workers are scheduled to lose unemployment benefits by the end of the year unless Congress authorizes an extension. An additional 850,000 could lose benefits in the first quarter of 2014. House and Senate Democrats have already introduced two bills to renew the federal program through 2014. It is doubtful that the bills will pass before Congress adjourns. It is doubtful that Republicans and Democrats will cooperate on a budget.

A mass of idle and discontented youths is a formula for social unrest. Indeed, high youth unemployment rates have been a driving factor in protest movements around the world, including the Arab Spring. There is no reason to believe that America will be spared the similar sight of protests, riots, street violence and the inevitable backlash by police.
Controlling civilians on its own soil is why the American police became militarized, in the first place. Arguably, a 1960s police unit in Delano, California was the first “high-risk team” that resembled the modern SWAT operation. The unit was organized as a specific response to the non-violent farm worker activism of the United Farm Workers led by Cesar Chavez. The police supported the growers and acted against the strikers in a manner that the courts found to be unconstitutional.
Perhaps the most path-breaking SWAT was established in Los Angeles in 1967 by Inspector Daryl Gates, who later became chief of police. Formed as a response to the Watts riots, the SWAT unit was inextricably tangled in the control of social and political dissent. The first high-profile use of the Los Angeles SWAT team was in December 1969 when the police attempted to serve search warrants on the Black Panthers headquarters. A four-hour gun battle ensued.
The militarization of law enforcement on every level has increased dramatically since the 1960s. Police departments are prepared to treat fellow Americans who protest as enemy combatants. [Editor's Note: Have you prepared accordingly yet? The violent results of this militarization will be much better to watch from a safe distance. Click hereto find out more about a great place to be while the US descends into riots and extreme police responses.]
CONCLUSION
The media and politicians cannot successfully lie to people about the food they can afford to put in their children's mouths. This is something people notice. Unemployment is a reality to which they wake up every morning. And, yet the media shakes its head in amazed confusion and asks, “Why is the recovery jobless?” The unemployed know the answer: because there is no recovery. What passes for progress – the rise of the stock market, for example – only reflects the quantitative easing that is skewing all economic data. What is real is what happens every time the state enters an industry or field of endeavor: stagnation.
It could be a long, hot summer.

OBAMA’S DREAM IS NOT THE AMERICAN DREAM
NOVEMBER 21, 2013
The American dream is a dream that goes back a couple of hundred years to when a bunch of guys got together in Philadelphia and came up with a formula for a new kind of country. The American founders believed that if this recipe was adopted, this new country would become the strongest, most successful, most prosperous country on the planet. And so it has been. Here we are, and we are on top of the world. The idea that America is based on a unique formula is called American exceptionalism.
In 2009, President Obama was asked, “Do you believe in American exceptionalism?” He gave a very odd answer. He said, “I believe in American exceptionalism” but then he added this, “Just as the Brits believe in British exceptionalism and the Greeks believed in Greek exceptionalism.” If everyone believes they are exceptional, then clearly no one is.
It’s worth stepping back for a moment and asking, “What is exceptional about America?” What would happen if you were to come to my native country of India; what if you lived there, worked there, stayed for many years, and maybe even took Indian citizenship Could you actually become Indian? No. Why not? Because to be Indian, you need two things; brown skin and Indian parents. Being Indian is a function of birth and blood. And so it is in most countries in the world.
But, not in America. In America, the Irish, the Italians, the Jews, the Koreans, and the West Indians can come here and can, in fact, become “American.” You become American by assimilating into a way of life, to a constitution and a rule of law. So that’s one aspect of American exceptionalism.
Here is another: America is a country founded on entrepreneurship, on trade, and on business. This may seem sort of obvious, but historically the entrepreneur, the merchant, and the trader have been reviled and looked down upon. Confucius said that the noble man knows what is virtuous but the low man knows what is profitable.
Even in Europe today, inherited money is better than earned money. Why? Because inherited money is innocent. It fell out of the sky. If you earned it, the assumption is that you probably had to run over some guys to get it. There is a prejudice against the nouveau riche, against earned wealth.
Historically there is a totem pole, and the businessman and the entrepreneur is at the bottom. But the American founders took that totem pole and flipped it. The entrepreneur is at center stage.
For me, the American dream is not merely a dream of economic opportunity. There is economic opportunity in America. But what is remarkable to me is how well ordinary citizens have it in America.
There is a material allure to America, but when I think of my own life, what has mattered most to me in coming to America is that here is a country where I get to write the script of my own life. Here is a country where my destiny isn’t given to me, it’s constructed by me. Here is a country where my life is a blank sheet of paper and I am the artist. I think this is why young people around the world are magnetically drawn to America: because America represents the self-directed life. This is the core of the American dream.
And then we have a different dream. This is Obama’s dream. Before we get into Obama’s dream, I do want to point out that there is a common view even among conservatives, even among Republicans, that the problem with Obama is that he is a bungler, he is an amateur in the title of a recent book, he tries to do x but he gets y.
This has produced a whole set of conservative punditry essentially lecturing Obama on things like, “Obama, don’t you realize that confiscatory taxation does not produce economic growth?” “Oh, Obama, don’t you realize that by blocking oil drilling in America you aren’t going to create jobs?” “Oh, Obama, may we advise you that Assad, the dictator of Syria, or the Mullah’s in Iran are not our friends?” “Obama, you should wake up to the fact that if we slash our own nuclear weapons this will not inspire the Iranians to do the same.”
Now you can begin to see why people get conspiracy theories about Obama. He’s a traitor. He’s a secret Muslim. He’s a Manchurian candidate.
I would like to offer a little different theory, and that is that Obama subscribes to an ideology that aims to reduce America’s influence in the world. He wants to cut America down to size. He doesn’t want America to be number one. He would be perfectly happy if we were number 18 or number 37.
Why does Obama want to reduce America’s footprint in the world? Because he believes we’ve been stepping on the world. This is his ideology. What Obama really wants to do is redistribute power globally. He would like to see many countries on the world stage – Brazil, India, China, Russia, all vying for power. No single superpower calling the shots.

NY Regulations On Guns Keep Constricting The Type Of Gun You Can Own. If Trend Continues, All Rubber Band Guns Will Be Illegal!

THE GUN CONFISCATION NOTICE AN NYC RESIDENT REPORTEDLY RECEIVED WILL LIKELY SEND CHILLS DOWN YOUR SPINE

New York City has reportedly started sending out confiscation notices ordering gun owners to “immediately surrender” rifles and/or shotguns capable of holding more than five rounds of ammunition. It is illegal to possess a rifle or shotgun with the capacity to hold more than five rounds in the city, according to NYC Administrative Code 10-306 (b).
An alleged notice sent to an NYC resident, dated Nov. 18, offers the gun owner the following options:
1. Immediately surrender your Rifle and/or Shotgun to your local police precinct, and notify this office of the invoice number. The firearm may be sold or permanently removed from the City of New York thereafter.
2. Permanently remove your Rifle and/or Shotgun from New York City…
[…]
3. You may call to discuss the matter if you believe your firearm is in compliance, or you may request the option to bring your firearm to a licensed gunsmith for a permanent modification and certification proving that it is permanently modified and in compliance.
New York City Sends Gun Confiscation Notice for Rifles, Shotguns
Source: Truth About Guns
While the confiscation notice, reported by the Truth About Guns, very well may be a normal occurrence in New York City, gun owners in firearm-friendly states like Texas or Arizona will probably have a hard time even imagining receiving such a letter from authorities over a rifle or shotgun that could potentially hold more than five rounds.
The notice above deals directly with New York City gun regulations, but there are also concerns of a potential state-wide gun confiscation effort in New York following the passage of the SAFE Act.
In addition to outlawing an array of semi-automatic rifles, the SAFE Act restricted ammunition magazines to seven rounds, down from 10. The law was later changed to allow gun owners to purchase magazines with the capacity to hold 10 rounds, however, only seven rounds can be loaded unless the firearm is being used at a gun range or shooting competition.
The SAFE Act also creates a more comprehensive database of people barred from owning guns, and makes New York the first state to require background checks to buy bullets. The system was also said to help flag customers who buy large amounts of ammo. In another provision, therapists, doctors and other mental health professionals will be required to tell state authorities if a patient threatens to use a gun illegally. The patient’s weapon could then be taken away.
It wasn’t immediately clear how aggressively the state of New York is enforcing the new magazine restrictions or if law enforcement planned to send out similar notices to the one above to gun owners across the state. Phone calls made late Wednesday night to the Gov. Andrew Cuomo’s office, the NY State Police and the NYPD were not returned.

KnockOut Game Also Involves Women Attackers.

‘AND WAMMMMMM’: TEENS RANDOMLY TARGET, BEAT UP SENIOR CITIZENS

A Fort Myers, Fla., teen was arrested this week for attacking senior citizens.
Traveshia Blanks is charged with two counts of battery in the seemingly random and senseless attacks, according to WBBH-TV.
One 72-year-old victim told the news station he was weeding his garden Tuesday when he was kicked from behind. The victim fell to the ground and said he saw a woman walking away laughing, joining a group of people.
“I was in shock. Who would expect anything from out of the blue to happen like that. There’s no reason had I done something or said something,” the victim told WBBH.

“I didn’t hear anything. There was nobody in the area at all. It was very quiet [when] all of a sudden I felt a blow to my hip and I was on the ground. I turned around to see what happened and there was a girl standing there laughing,” he said.
That same day another man was attacked. Harry Hurvitz told WBBH his doorbell rang Tuesday and he answered, seeing well-dressed teens outside.
“I stepped out to see what she was pointing to and there was another girl standing here and wammmmmm,” the 89-year-old man said.

Harry Hurvitz told the news station he doesn’t think teens realize the harm they could be causing to an older person. An attack might not just result in physical wounds, but could cause a heart attack or other ailment from shock. (Image source: WBBH-TV)
Again, the group laughed and fled.
Authorities identified the 15-year-old involved by footage taken of the attacks. Blanks, when apprehend, admitted to beating the men. She is now spending 21 days in a detention facility before her court date on Dec. 19.
The random acts of violence seem to follow what appears to be a growing, disturbing trend known as the “knockout game,” which involves targeting someone and trying to knock them out in one swing. Teens previously interviewed about the game have said they do it just “for the fun of it.”

The safety of people targeted by such attackers is not all Hurvitz told WBBH he worries about though.
“There are lots of old ladies here who have guns and revolvers in their possession and will not open the door unless they are fully armed. And they will just let loose,” he said, telling the news station he was actually glad he was attacked and not someone else.
