Alan Dershowitz argues 'Hollywood Access' tape was recorded illegally

Famed lawyer Alan Dershowitz discussed a "theory" Wednesday, one day after meeting with President Trump, about how the "Hollywood Access" tape was illegally recorded.

In that tape from 2005, which surfaced during the 2016 election, Trump could be heard talking with former “Today” show host Billy Bush on a bus, via hot mic, about groping women without their consent.

Dershowitz said during a panel on CNN that because California, where the exchange took place, is two-party consent state, the taping was illegal.

Host Anderson Cooper noted that they were wearing microphones, but Dershowitz dismissed that as being a disqualifier.

"But they didn't know it was on. That was the question," he said.

The "Hollywood Access" tape was dredged up again this week after FBI agents raided the hotel room and office of Trump's lawyer Michael Cohen. Among the documents they took, agents confiscated records related to the tape as well as adult film star Stormy Daniels, who alleges she had an extramarital sexual encounter with Trump.

Dershowitz imagined a hypothetical conversation about what Trump may have said to Cohen about the "Access Hollywood" tape and may be in the documents obtained by FBI agents.

"I can imagine the conversation," he said. "Trump calls his lawyer, Cohen, and says, 'Stop this tape. It's illegal. I didn't consent to it. I didn't know the microphone was on. Stop it. Use all legal means.'"

He said the documents would now go through a government "taint team," which would determine if some of the material is, for example, protected by attorney-client privilege.

The prospect of a lawsuit over the "Access Hollywood" tape has been raised before, by Trump himself.

Back in 2016, during an interview with former Fox News host Bill O'Reilly, Trump said NBC releasing the tape was an "illegal act" and expressed a willingness to sue.

Robert Barnes, California-based attorney, said at the time Trump may have a case and explained how the hot mic audio could be illegal.

Dershowitz warned on Monday that the FBI raid was an assault on the privileged lawyer-client relationship and served as a sign that special counsel Robert Mueller, who is investigating whether the Trump campaign colluded with the Russians, is trying to turn Cohen against Trump.

Dershowitz met with Trump and other White House officials on Tuesday. He claims his visit was prearranged and regarded the ongoing peace process in the Middle East, but has refused to open up on any other matters that may have been discussed.

Dershowitz has been one of Trump's staunchest defenders on TV in recent months.

During the CNN panel on Wednesday, Norman Eisen, a one-time Obama White House ethics lawyer and chairman of Citizens for Responsibility and Ethics in Washington, offered counter-points to Dershowitz's comments, but did concede Dershowitz might be right about the raid.

"You just heard the world's smallest violin playing for Alan's argument," he said. "Why? We can have confidence that this seizure of records was reviewed at the Justice Department, at the staff level. Then by [Deputy Attorney General] Rod Rosenstein, then it was sent over to the U.S. Attorney's office and reviewed again by the public corruption unit here. It could be that Alan is right."

Cooper interjected: "And a judge would have signed off on this search warrant."

Eisen added that judicial permission would be needed and that the "prosecution has powerful reasons" for the raid.

Prosecutors are looking at a "pattern of illegal conduct," including allegations of threats made against Daniels to keep silent about her alleged tryst, Eisen said.

Eisen also argued that he doesn't expect any leaks from the FBI raid, to which Dershowitz scoffed: "Boy I got a bridge to sell you in Brooklyn. No leaks? Oh my God, a leak? It sounds like a scene from 'Casablanca.' Leaking is pervasive."

Will Anything Come From The Women's March?

The Women’s Protest March Was Yuge — But So What?

On January 21, the day after new President Trump’s long-awaited inauguration, a very different crowd made its way into Washington, D.C. Most observers say this crowd was significantly larger than the turnout for Trump.

But less important than the crowd’s size — which was estimated by some sources at over one million marchers — was their message and their political will. These marchers were nearly all women, and almost all of them were angry about Trump’s secretly recorded comments of 11 years ago made by television tabloid show Access Hollywood when Trump thought he was enjoying a bit of privacy with host Billy Bush.

We all know the contents of that tape, but it wasn’t just those comments that brought marchers out; it was a larger perceived threat to women’s rights — including abortion, LGBT protections, equal pay and other issues.

However, if one questioned a typical young marcher, in most cases, she was only able to cite the now-famous tape of Trump’s misogynist remarks, something about Planned Parenthood and not much else, other than that Trump and his cabinet are from a conservative class of politicians that they thought had been permanently banished from Washington after eight long years of the progressive administration of Democrat Barack Obama.

That the Women’s March was so large is a testament to the influence of the usual suspects of the globalist media — specifically, outlets such as CNN, The Huffington Post, The New York Times, The Atlantic magazine and The New Yorker — all liberal stalwarts that have by now figured out that branding Trump a racist or a homophobe are more or less two strikes out (there’s much extant video of Trump repudiating racists, and nary a word can be found online of Trump insulting gay people).

On the other hand, calling him a misogynist results in plenty of Google hits and video clips. And so, the “trigger” reaction of getting women to march was fairly easy to pull; what was surprising was the huge turnout of rude, angry protesters who left the city full of garbage and homemade detritus when they exited.

The demographic spectrum of marchers was not as wide as the March’s organizers would have liked; some marchers held up signs castigating white women for voting for Trump — thus betraying their sex — while others decried the fact that the march lacked a specific purpose other than to complain vaguely and generally as Trump had not actually taken any political action yet.

But what encouraged veteran organizers was the fact that there were older women mixed in with the crowd, who are statistically more likely to vote and possibly organize — if they’re motivated to do so.

At Washington D.C. think tank American Enterprise Institute, scholar Stan Veuger wrote a study of how demonstrations that formed the Tea Party transformed into political actions that put the group’s candidates into office and allowed the party to be taken seriously as a movement. Of the Women’s March, he said, “Political protests can have an effect. But there’s nothing guaranteed.”

Some past marches on Washington have boasted similar numbers of participants as 2017’s Women’s March, but brought about scant political change, such as the protest against the Iraq War in 2003 or the African-American-centric Million Man March in 1995.

Another example is the storming of the state Capitol building in Wisconsin in 2011 by citizens after Governor Scott Walker moved to weaken unions in the state. Tens of thousands of people participated, but Walker was still reelected in 2012 in a special recall election.

Indeed, as President Trump tweeted about the Women’s March, “Watched protests yesterday, but was under the impression that we just had an election! Why didn’t these people vote?”

Saudi Garcia, a female graduate student at New York University who participated in the march in Washington, knows about following up protests with action. “We need to be like the Tea Party was in 2009,” Garcia said. “Those people were relentless — showing up at town council meetings, everywhere.”

Beth Andre, an academic crisis services worker from Austin, Texas, who marched there instead of in the nation’s capital, echoed Garcia’s sentiment. “We want to be able to harness that energy and anger that we have right now and turn it into something good.”

The organizers of the Women’s March promised participants that there would be 10 additional actions they could take in “the first 100 days” of the Trump administration, but so far they’ve only announced one of them — writing to one’s senator or representative — a step that’s typically not followed by many people.

But one person who’s surely delighted with the oversized turnout on January 21 is billionaire liberal activist George Soros. It was confirmed recently by online news reports that Soros was connected with at least 50 organizations that had played a part in the March.

Soros isn’t a novice when it comes to political action, but counting solely on women as a group is likely not as reliable as a working with a broader coalition of people. So, while women may compose a solid core of Soros’ army of anti-Trump protesters and activists in the future, their unreliability at the polls means that he’ll probably have to integrate them into a larger movement — something that may not be feasible with the ease that he would prefer.

On Friday, the Clinton Campaign (Washington Post) released video of Donald Trump bragging about grabbing p*ssy in an off the record conversation with Billy Bush.

The Los Angeles Times reported hours after audio was released of Donald Trump making sexually suggestive comments about a woman, that House Speaker Paul D. Ryan castigated Trump and said he would no longer attend their scheduled event on Saturday.

“I am sickened by what I heard today,” Ryan said in a statement. “Women are to be championed and revered, not objectified. I hope Mr. Trump treats this situation with the seriousness it deserves and works to demonstrate to the country that he has greater respect for women than this clip suggests.”

Paul Ryan was scheduled to campaign with Trump for the first time on Saturday.
It never happened.

On Sunday Donald Trump crushed Hillary Clinton in one of the most lopsided debates in political history. It was a brilliant performance. Trump made everyone forget about the WaPo tape.

On Monday Paul Ryan sabotaged Donald Trump again and changed the political narrative.

Ryan announced he will not campaign with or defend Donald Trump for the rest of the election cycle. This was an odd statement considering Paul Ryan has not once defended Donald Trump this year. He’s only attacked Trump, the record-setting Republican primary winner.

Liberty University president Jerry Falwell, Jr. suggested today that GOP elites may have leaked the video.

Now this…
There are “rumors” that Paul Ryan’s close advisor #NeverTrumper Dan Senor is behind the leaks.

I spoke with a reporter tonight who believes the reports are true. It was GOP elites who released the audio to the Washington Post.

Dan Senor has been pushing the WaPo audio all day. He is determined to keep the story alive.
