How Can We Trust Hillary When She Cannot Follow The Rules? (We Know--They Don't Apply To Her--Only Her Subordinates)

Donald Trump Friday weighed in on the latest development in the Hillary Clinton email scandal, calling it a disaster on Twitter and raising questions about her fitness to occupy the White House.

The State Department said for the first time on Friday that 22 emails requiring one of the highest levels of top secret classification were on Clinton's unsecured home server.

The agency's security and intelligence operations are investigating whether the emails were classified when the landed on Clinton's server.

The disclosure comes just three days before the Iowa caucuses. Clinton is on the Democratic slate, in the first contest of the 2016 presidential season.

Will Huma Be Indicted But Not Hillary?

California Rep. Darrell Issa says the FBI has a “slam dunk” case against former Secretary of State Hillary Clinton and senior aide Huma Abedin that it’s itching to prosecute.
The former House Oversight chairman’s statement on Friday comes just days after former Republican House Majority Leader Tom DeLay said his contacts in the agency will “blow the whistle and go public” if Attorney General Loretta Lynch does not prosecute.

“I think the FBI director would like to indict both Huma and Hillary as we speak,” Issa said at Florida Sen. Marco Rubio’s New Hampshire campaign headquarters on Thursday, the Washington Examiner reported. “I think he’s in a position where he’s being forced to triple-time make a case of what would otherwise be, what they call, a slam dunk.”
Approximately 100 FBI special agents are assigned to an investigation that will determine if the former secretary of state violated a subsection of the Espionage Act related to “gross negligence” in handling government documents. Dozens of agents were required to sign non-disclosure forms before examining classified information and trying to determine whether co-mingling of the Clinton Foundation and State Department business violated public corruption laws.

“You can’t have 1,300 highly sensitive emails that contain highly sensitive material that’s taken all, or in part from classified documents, and have it be an accident,” Issa said, the newspaper reported. “There’s no question, she knew she had a responsibility and she circumvented it. And she circumvented it a second time when she knowingly let highly classified material get onto emails in an unclassified format.”
Issa’s and DeLay’s comments also follow an exclusive Fox News investigation that revealed Clinton had beyond “top secret” intelligence pass through her “home brew” email server. The network obtained an unclassified letter by Intelligence Community Inspector General I. Charles McCullough III that shows Clinton’s server contained intelligence known as “special access programs,” or SAP.
“To date, I have received two sworn declarations from one [intelligence community] element. These declarations cover several dozen emails containing classified information determined by the IC element to be at the confidential, secret, and top secret/sap levels,” said the Jan. 14 IG letter to lawmakers with oversight of the intelligence community and State Department. “According to the declarant, these documents contain information derived from classified IC element sources.”
Issa said that FBI Director James Comey would have an uphill battle to get the Obama administration to prosecute Clinton – even with a “slam dunk” case.
“I’ve worked with both the last attorney general … and this attorney general, and I really don’t believe they’ll do it,” Issa told the newspaper. “Doing it, by definition, would end her run for president.”

If Obama Did Not Want Hillary Investigated, He Would Make Lynch Invoke Prosecutorial Discretion

Lynch: Lois Lerner was protected by prosecutorial discretion

POSTED AT 7:21 PM ON NOVEMBER 18, 2015 BY JAZZ SHAW

This seems to be one of the more popular phrases popping up in both the State Department and the Justice Department these days: prosecutorial discretion. Even though the phrase seems fairly self-explanatory, here’s a quick definition:
Prosecutorial discretion refers to the fact that under American law, government prosecuting attorneys have nearly absolute powers. A prosecuting attorney has power on various matters including those relating to choosing whether or not to bring criminal charges, deciding the nature of charges, plea bargaining and sentence recommendation. This discretion of the prosecuting attorney is called prosecutorial discretion.
The reason the term is important is because it’s cropping up more and more in certain high profile cases inside the Obama administration. National Review’s Joel Gehrke comes up with the latest example and it involves none other than Lois Lerner. She was due for a meeting with some legal eagles after her hearings on the Hill, but that never came to pass. The decision to pass on the matter lands in the lap of Attorney General Loretta Lynch.
Justice Department officials used “prosecutorial discretion” to shelter former IRS official Lois Lerner from a grand jury after she was held in contempt of Congress.
“I believe that in the exercise of prosecutorial discretion, the matter was handled and was resolved,” Attorney General Loretta Lynch told the House Judiciary Committee on Tuesday morning.
The administration’s invocation of prosecutorial discretion has become familiar to lawmakers through the debate over President Obama’s recent series of executive orders on immigration, and it frustrates Republicans. Lynch’s answer particularly annoyed Representative Darrell Issa (R., Calif.), who led much of the investigation into the IRS’s Tea Party targeting scandal when he was chairman of the House Oversight and Government Reform Committee.
This exchange clearly had Issa feeling a bit on edge and he cited a bit of law which was intended to show that Lynch was falling down on the job. He read to her from the federal statute governing congressional contempt citations. It’s an interesting approach on his part. Here’s the relevant text. (Emphasis added)
Whenever a witness summoned as mentioned in section 192 of this title fails to appear to testify or fails to produce any books, papers, records, or documents, as required, or whenever any witness so summoned refuses to answer any question pertinent to the subject under inquiry before either House, or any joint committee established by a joint or concurrent resolution of the two Houses of Congress, or any committee or subcommittee of either House of Congress, and the fact of such failure or failures is reported to either House while Congress is in session or when Congress is not in session, a statement of fact constituting such failure is reported to and filed with the President of the Senate or the Speaker of the House, it shall be the duty of the said President of the Senate or Speaker of the House, as the case may be, to certify, and he shall so certify, the statement of facts aforesaid under the seal of the Senate or House, as the case may be, to the appropriate United States attorney, whose duty it shall be to bring the matter before the grand jury for its action.
I’ll have to pitch this one to the professionals, but it seems to be a rather exceptional set of circumstances under the law. In normal practice for criminal cases around the country, law enforcement gathers evidence to make the best case they can and turns it over to the District Attorney who may or may not bring the case to trial. Most commonly, if they find the case so weak that they’re pretty sure they’ll lose in front of a jury, they’ll just pass on prosecuting it. Nothing wrong with that, and it saves the taxpayers a lot of time and money in chasing cases which most likely can’t be won. If it’s a case involving someone they have a personal connection to they’re suppose to recuse themselves.
This statue, as it applies to Contempt of Congress, seems to be worded a bit differently. It clearly removes any options from the President of the Senate or the Speaker of the House in terms of certifying and processing the case by saying, “and he shall so certify.” Then, the appropriate United States Attorney – being somebody from the Justice Department – is told that it is their “duty” to bring the matter before a grand jury. Does this remove the option of just passing on the case? Did Lynch break the law?
For another case of prosecutorial discretion, reference Huma Abedin’s embezzlement case.

Big Mouth Elitist Gruber Might Be What We Need To Rid Ourselves Of ObamaCrapCare

Politico: GOP's 'Dream Witness' Gruber Could Doom Obamacare

Obamacare architect Jonathan Gruber faces a GOP grilling when he testifies on Tuesday before the House Oversight Committee conducting an investigation into the controversial Affordable Care Act.

Gruber, who called Americans “stupid” while discussing the healthcare law, will endure a ton of tough questions over his videotaped statements from Republican Rep. Darrell Issa’s committee, particularly stunning comments he made that could lead to the dismantling of Obamacare, according to Politico.

“For some Republicans, Gruber is a dream witness,” wrote Politico’s David Nather. “All they have to do is play the videos that confirm their worst suspicions about President Barack Obama’s signature healthcare law, especially the one where Gruber boasts that ‘lack of transparency is a huge political advantage’— and watch him squirm.

“Better yet, they can ask him about the video that presents the biggest danger of all to the White House: the one where he undermines the Obama administration’s case in the upcoming Supreme Court lawsuit that could bring a screeching halt to subsidies for millions of Obamacare customers.”

Nather is referring to comments that Gruber made about the central issue in an Obamacare lawsuit in front of the Supreme Court — whether the law allows subsidies for people receiving health insurance through the federal marketplace that covers 37 states, not just for customers who get it from state-based exchanges.

“If the justices decide that it doesn’t — thanks to the way one section of the law is worded — it can gut most of the law,” wrote Nather.

Last month the Supreme Court agreed to hear the case, which claims that, according to the language of the law, the insurance subsidies under Obamacare should only be available in states who created their own healthcare exchanges and are not part of the HealthCare.gov federal exchange.

In a video recorded in January 2012, Gruber seemed to confirm the same argument that the plaintiffs in the Supreme Court lawsuit are making: “If you’re a state and you don’t set up an exchange, that means your citizens don’t get their tax credits,” according to Nather.

Obama administration staffers who worked on the healthcare legislation say that the language of the legislation was meant to mean that the law gives everyone the right to apply for and receive subsidies, including the millions enrolled on the federal exchanges, Politico reported.

But Gruber’s embarrassing video is included in the petition to the Supreme Court, and it is expected to come up in the oral arguments.

Michael Carvin, the lead attorney for the plaintiffs, told Politico that “Gruber is Exhibit A that any English-speaking person knows what the subsidies language says.”

Gruber, an MIT economist, has since backed off from his remarks, saying that at the time of his speech it wasn’t clear that the federal exchange would even be ready in time for the start of enrollment, according to the political news website.

The furor started last month when a video surfaced showing Gruber, who made millions consulting on Obamacare, apparently criticizing the healthcare act while talking to fellow academics in 2013.

He said: “The bill was written in a tortured way to make sure the CBO [Congressional Budget Office] did not score the [health insurance mandate] as taxes. If CBO scored the mandate as taxes, the bill dies."

He also said: "Lack of transparency is a huge political advantage. Call it the stupidity of the American voter, or whatever."

The video caused a firestorm that resulted in White House officials scrambling to downplay Gruber's pivotal role in the law's creation.

Will Only "Sensible" Legislation Be Passed By Republican Congress

Darrell Issa: GOP Sweep a Mandate for 'Sensible Legislation'

After Tuesday's GOP sweep, Rep. Darrell Issa says he sees a clear mandate for congressional Republicans to step in and make "sensible" change on behalf of voters, the Daily Caller reported.

"In a nutshell, and I'll sound a little bit like George Will, they didn't vote Republicans in tonight," said Issa, who called big GOP gains on Tuesday "superb."

"They voted the president out," he told the Daily Caller. "And that means that we have a mandate to pass sensible legislation."

Issa was not gloating, noting that bipartisan successes in the House could serve as a launching point for future Senate cooperation.

"Many of the pieces of legislation that we already passed out of the House with bipartisan support from the Democrats, those kinds of pieces of legislation, I think are greatexamples," he said, as Republicans now take over Senate majority along with the House.

Issa, 61, and the powerful head of the House Oversight and Government Reform Committee who has served since 2001, enjoyed an easy re-election victory on Tuesday as he ousted Democratic challenger Dave Peiser in California's 49th Congressional District, the Huffington Post reported.

He will return to Washington facing not only new colleagues but newly-emerging insults from the U.S. Justice Department, where Attorney General Eric Holder called Issa and his House watchdog colleagues "idiots" in newly-released "Fast and Furious" investigationdocuments, NPR reported.

Wrote Holder in a 2011 memo: "Issa and his idiot cronies never gave a damn about this when all that was happening was that thousands of Mexicans were being killed with guns from our country. All they want to do — in reality — is cripple ATF and suck up to the gun lobby. Politics at its worst — maybe the media will get it."

Issa says he will focus on righting "glaring" mistakes made by the Obama administration, which led to the Democrats' deep midterm defeats, the Daily Caller noted.
"There are glaring mistakes that have happened in this administration that need to be corrected," he said, noting of GOP successes: "I think it is very much an example where even when people didn't want to be seen with the president, they were still seen as being with the president."
