Nevada judge dismisses case against Cliven Bundy and sons, says government can’t retry them

LAS VEGAS — A federal judge ruled Monday that the federal government could not retry Cliven Bundy and his sons after rebuking prosecutors for withholding evidence during their felony trial stemming from an armed standoff four years ago.
U.S. District Court Judge Gloria Navarro declared a mistrial in the case last month, saying federal prosecutors willfully withheld evidence that lawyers for the Bundys and alleged co-conspirator Ryan Payne should have had access to while mounting their defense.
She said the attorneys were in violation of the Brady rule, which requires prosecutors to disclose evidence that could be favorable to a defendant, and told them it wasn’t possible to proceed with the case.
On Monday, she dismissed the case “with prejudice,” meaning the government cannot retry the defendants. “The court finds that the universal sense of justice has been violated,” Navarro said.
It was yet another defeat for the federal government at the hands of the Bundy family, who have managed to elude prosecution in high-profile trials centered around standoffs with law enforcement over access to public land.
Twice this year, Las Vegas juries acquitted or deadlocked on felony charges against Bundy supporters. Ammon Bundy, 42, and Ryan Bundy, 44, both beat federal felony charges in a case stemming from a 41-day standoff at an Oregon wildlife preserve two years ago.
In the most recent case, the prosecutors alleged Bundy and his sons riled up supporters after the federal government came to remove grazing cattle from U.S. Bureau of Land Management property outside Bunkerville, Nev., in 2014. The government said the Bundys’ incendiary language and actions led to the armed standoff outside the family’s ranch about an hour north of Las Vegas.
The four defendants were charged with threatening a federal officer, carrying and using a firearm and engaging in conspiracy — felony counts that could send them to prison for decades.
Despite the mistrial, federal prosecutors argued in a legal brief filed Dec. 29 that they didn’t willfully withhold evidence from the defense and they still planned to press ahead with another trial.
Assistant U.S. Attorney Steven Myhre wrote in his brief that the government shared 1.5 terabytes of information and noted it was “by far, the largest review and disclosure operation in this (U.S. attorney’s office) history.”
Myhre also argued the government needed to protect some witnesses from leaks that might lead to threats, so it “culled the database with witness protection in mind.”
“Unprecedented database volume and witness concerns aside, the government never let these obstacles stand in the way of diligently working to fulfill its discovery obligations,” he wrote.
But defense lawyers for Payne — Renee Valadares, Brenda Weksler and Ryan Norwood — argued in their Dec. 29 briefing seeking to dismiss the case that government “failed to accept responsibility for any of its failure to disclose evidence” and the withholding of evidence was “flagrant prosecutorial misconduct.”
“The government’s irresponsible and, at times, false proffers to this Court as well as its dismissiveness toward the defense inspires no confidence in the prospect of fairness,” they wrote. “A dismissal is necessary to remedy the constitutional violations, to preserve the integrity of this court’s processes, and to deter future misconduct. Anything short of a dismissal is tantamount to condoning the government’s behavior in this case.”
The case has fueled anger and mistrust among groups that view the federal government as overzealous and overreaching in using its power and authority to squash free speech and states’ rights.

The militarized police response to protests in Ferguson, Missouri has led Americans from all walks of life to question whether law enforcement agencies have gone too far in arming themselves and training as though the civilian population is an ever-present enemy.
Meanwhile, leaked documents from the Department of Homeland Security suggest that police militarization is only likely to increase as officials claim that they are planning for increased “anti-government violence over the next year.”
DHS’s seven-page report, “Domestic Violent Extremists Pose a Threat to Government Officials and Law Enforcement,” cites the standoff between the Feds and Nevada rancher Cliven Bundy as a “perceived victory at Bunkervile” for domestic extremism that will “likely prompt more violence.” DHS officials go on to cite the crimes of Jerad and Amanda Miller, who killed three people in Las Vegas after spending a brief time at Bundy’s ranch before being asked to leave, as more evidence of increasing extremism.
After years of only sporadic violence from violent domestic extremists motivated by anti-government ideologies, I&A has seen a spike within the past year in violence committed by militia extremists and lone offenders who hold violent anti-government beliefs. These groups and individuals recognize government authority but facilitate or engage in acts of violence due to their perception that the United States Government is tyrannical and oppressive, coupled to their belief that the government needs to be violently resisted or overthrown.
If the DHS report sounds familiar, it’s because it echoes the sentiments of a report produced earlier in the summer by the liberal Southern Poverty Law Center.
The organization argued in its executive summary:
For those harboring deep hatred of the federal government, the BLM pullout was seen as a dramatic victory, one instance where the armed radicals of the right stared through their own gunsights at the gun barrels of law enforcement officials and won. Rather than being condemned, their actions garnered the support of numerous politicians, including the governor of Nevada and commentators like Fox News’ Sean Hannity — a truly repulsive spectacle. This pandering to the far right by both politicians and media figures ended in a hurry, however, when Bundy engaged in racist blather about “the Negro.” Racism was crossing a line, apparently, but the calls from the ranch for revolution and outright defiance of federal law enforcement seemed to be just fine with the Hannitys of the world.

Cliven Bundy Still Has Support By Neighbors. He Should!

Here’s How the Residents of Bunkerville Feel about Cliven Bundy

Cliven Bundy and his family have been receiving an overwhelming amount of support from Patriots across the U.S. because of his stand against against the BLM.
Fortunately for Bundy, the support doesn’t stop there. Many in his hometown of Bunkerville, Nevada have quickly come to the defense of the proud American rancher.

The support for Bundy comes from people who are upset by the Gestapo-like tactics perpetrated by the BLM and frustrated with the local sheriff for not stepping in and regulating the entire affair.
“I’m really disappointed in our sheriff for not being out here to protect the citizens who are out here,” one council member mentioned at a recent town hall meeting.
The citizens of Bunkerville noted that Clark County Sheriff Doug Gillespie and his staff were noticeably absent during the conflict.
In fact, as reported by some of those in the Sheriff’s department, Gillespie and his staff were reluctant to get involved for fear of their own safety. They feared that had the situation escalated they would have been caught in the deadly crossfire between BLM agents and armed citizens.
Most have dismissed the accusations against Bundy for being a racist because they know the true nature and character of the loyal and non-prejudicial American.
They’ve instead taken issue with the fact that the BLM abused Bundy, his land, his animals, along with others who were standing against a gross abuse of government authority.
As reported by Infowars, one lady said:
“I called the metro and their exact words to me were: ‘It’s the BLM and Cliven’s problem and I should take it up with one of those two.’ That is Bullcrap! Those are my children and this is my community, and if metro does not have the guts to come out and protect us, what are you here for? What are we paying you guys for?”
The truth is a large number in the community are so concerned with the issue that many in the town have gone forward with a formal complaint against the Feds. The complaint reads:
“We believe that the BLM men who pointed guns at over 1,000 people on April 12th near the I-15 freeway south of Mesquite committed a criminal act and the Clark County sheriff’s office should be required to investigate.”
Though the fracas has died down in the past few weeks, it doesn’t mean that Bundy and his town are going to let this issue slide.

One thing Ron Paul has been well known for is his distinct ability to predict how public policy would shape the look of the United States years down the road.
Which is exactly why his warning that arming U.S. bureaucrats would create a slippery slope for American citizens is now coming to light after the recent interaction between Cliven Bundy and the BLM.

In 1997, Paul proclaimed that the increased armament of federal officials would begin to create a state of affairs where militarized officials would begin to present a clear and present danger to U.S. citizens on a regular basis.
In a speech before the US House, Paul said:
It’s “ironic that the proliferation of guns in the hands of the bureaucrats is pushed by the anti-gun fanatics who hate the Second Amendment and would disarm every law-abiding American citizen.”
“Yes, we need gun control. We need to disarm our bureaucrats, then abolish the agencies. If government bureaucrats like guns that much, let them seek work with the NRA.”
“Force and intimidation are the tools of tyrants. Intimidation with government guns, the threat of imprisonment, and the fear of harassment by government agents puts fear into the hearts of millions of Americans.”
And as the events that took place on Bundy ranch have adequately proven, the time where the U.S. government has begun to overstep its boundaries is upon us.
Just weeks ago BLM employees harassed U.S. citizens at gunpoint…executed privately owned livestock…and threatened the seizure of legally held land at the tip of automatic machine guns.
This kind of fallout was certainly on Paul’s mind 17 years ago when he made these predictions and commented that,
“Under the Constitution, there was never meant to be a federal police force… Even an FBI limited only to investigations was not accepted until this century. Yet today, fueled by the federal government’s misdirected war on drugs, radical environmentalism, and the aggressive behavior of the nanny state, we have witnessed the massive buildup of a virtual army of armed regulators prowling the states where they have no legal authority.”
The truth is such use of force was never meant to be a part of reasonable relations between citizens and government officials.
However, with increasing frequency, it’s exactly what continues to play out right before our eyes.

The shrieks and caterwauling of the politically correct crowd over alleged “racist” comments by a rancher and a NBA owner/slum lord reveal their utter hypocrisy and disdain for liberty.
The tolerance crowd tells us everyone must be tolerant of “alternate lifestyles” and gay “marriage” and non-Christian religious practices. They create out of whole cloth hate crimes and thought crimes in order to enforce their “tolerance.”
Yet the tolerance crowd does not tolerate contrarian opinions.
Brendan Eich was drummed out of his position at Mozilla by the tolerance crowd after it was revealed he contributed to Prop 8 in 2008. Cliven Bundy pointed out the slavery inherent in government entitlements and was figuratively tarred and feathered and abandoned by his spaghetti-spined opportunistic pseudo-friends. Donald Sterling has been banned for life from attending games played by and operating a team he owns, and he may have his property forcibly removed by the tolerance crowd over private comments recorded and released illegally — comments like those likely uttered by NBA players at one another during the course of every game and certainly no more offensive than those off which President Barack Obama’s favorite rapper, Jay Z, makes millions of dollars annually.
The tolerance crowd works daily to remove any mention of the Christian God from the public square and even public life, but insist Christians be tolerant of Islam and the religion of Atheism. The tolerance crowd insists Christians must tolerate – and support monetarily – the murder of innocents in the womb, and they won’t tolerate anyone who speaks out against abortion. The tolerance crowd has no tolerance whatsoever for guns and gun owners or kids with toy guns or even food shaped like guns.
Political correctness is the opposite of tolerance. PC is about conformity to government- and elite-approved thought, speech and deed. The government, its politicians and its idiot PC-preaching pawns do all they can to force political conformity.
Political conformity and compliance is what PC is all about. It is fascism. It is anathema to liberty.

What Bundy Said Was Impolitic But Has A Basis In Facts

First of all, let me begin by making an apology to Cliven Bundy.
In a slapdash column yesterday, I gave the New York Times more credit and credibility than it deserved.
I assumed, inappropriately and incorrectly, that the former newspaper of record had actually recounted the words of the Nevada rancher accurately and in context, given that there was an actual recording of the comments.
I was wrong.
After the Times smeared as a rock-ribbed racist through the use of selective quotes the new hero of resistance to tyranny in America, there was a new development: The video recording of the actual remarks emerged.
To say the New York Times bent over backwards to make Bundy look like an unregenerate bigot would be an understatement. I suggest you view the video for yourself at the end of this column. Does he seem like a hater to you? Or does he actually sound like a man with compassion for blacks who have been systematically abused by a new plantation mentality imposed by government dependence?
I did get one thing right, however. I explained it wasn’t really Bundy the New York Times was out to get. It was his supporters – especially elected officials who denounced the heavy-handed and militaristic way the Bureau of Land Management went after Bundy and his family.
It’s called guilt by association – something “progressives” formerly denounced. But, in this case, there was nothing to feel guilty about, because Bundy didn’t say anything racist.
Meanwhile, the guy who I suspect is the mastermind of the efforts by government to make an example of Cliven Bundy yesterday showed his own hand.
Senate Majority Leader Harry Reid called on all of his “progressive” friends to form a “united front” against Bundy.

For those of you untrained in the tactical and strategic arts of the totalitarian left, let me explain that terminology. “United front” has special meaning to only one group – communists. If you doubt what I, a former commie, have to say about it, just Google the term. See for yourself. What Harry Reid’s use of this term suggests is the left considers Cliven Bundy and all those rallying around his cause to be the most important target of the day. The “progressives” are apoplectic about this showdown in the desert. After all, they are supposed to be the champions of hardworking people. The government is supposed to be the friend and savior of working people. Yet, what Cliven Bundy has done, using “progressive” terminology, is to “heighten the contradictions” of socialist reality.
Therefore, as the left often concludes in such cases, he must be destroyed.
That’s why Harry Reid calls him a “domestic terrorist.” That’s why Harry Reid calls for a “united front” against this simple, seemingly powerless rancher. That’s why Harry Reid strangely said after the standoff in the desert was defused, “It’s not over.”
The left has big plans for Cliven Bundy.
The left sees Bundy as a real threat.
And I suspect that’s why the official mouthpiece of the establishment left – the New York Times – jeopardized what’s left of its own reputation by misconstruing and misrepresenting Bundy’s remarks.
He’s that dangerous!
That’s why it was so important to demonize him as a “racist.” They want to use him as a dividing point: Line up behind the “racist” or against him. That’s the strategy – even though race is not even an issue in the controversy Bundy started by merely doing what his family has been doing in the Nevada desert for over 100 years.
Do you get it?
He’s a symbol. For some of us he’s a symbol of a fight against encroaching tyranny. For others he’s a symbol of resistance to achieving their socialist panacea.
It’s the old divide-and-conquer strategy.
They can’t win with the facts, with reality, with truth. So they need to create a fog to obscure what’s really taking place on the ground.

After a lengthy conversation, embattled Nevada cattle rancher Cliven Bundy finally understood the racist tone of his remarks and apologized privately, according to Niger Innis, the national spokesman for the Congress of Racial Equality.

Bundy brought nationwide attention and support for his battle with the federal government over grazing rights when he faced down armed agents from the Bureau of Land Management as they seized several hundred of his cattle.

Many of those who came to the support of the 67-year-old fled for cover when The New York Times quoted him as saying he was "wondering" if blacks are better off now than they were under slavery.


Innis, who is running for Congress in Nevada, told J.D. Hayworth on "America's Forum" on Newsmax TV that he spoke with Bundy for about an hour on Thursday and finally got him to realize the repugnant nature of his comments.

"We talked for about an hour, and it was a good give and take," Innis said. "At first, Cliven kind of stood his ground and said, 'I said what I said, and I stand by it.' I communicated to him, and this is when he really got it.

"I said, 'Cliven, the freedom of choice, the freedom to use our lands, the people of Nevada to use our land for economic development and so on and so forth against the federal government is, that freedom that you're fighting for, is the freedom that was denied to millions of African Americans. That was the greatest sin of slavery is that it denied millions of African Americans of their ability to pursue happiness.' When I said that it was almost like a light bulb went on, he apologized to me."

Innis said he does not believe Bundy to be inherently racist but said that he "clumsily" used a bad metaphor to try and make an important point.

"What would've been better is if Cliven had said, 'Look, there are a number of blacks and Latinos and poor whites now that are involved in a real slavery, which is the slavery of government dependence,'" Innis said. "I'm up here in Tonopah, which is part of my district, and I was just talking with a local businesswoman who pointed across the street and talked to me about low-income housing or free government-subsidized housing and how the people there do not work because they don't have to.

"They may not even know that they are slaves, but there is in fact a neoslavery that exists. When you take out individual initiative, individual responsibility, and the hope that every individual is born with, to better their lives, to climb the economic ladder, to pursue happiness, that is in fact a neoslavery."
