FBI agents trying to determine if the presidential hopeful violated a subsection of the Espionage Act related to "gross negligence" during her time as President Obama's top diplomat are likely thrilled that cyber-criminal Marcel Lehel Lazar is in U.S custody. Lazar's successful hacking of Clinton confidant Sidney Blumenthal's email revealed to the world that clintonemail.com was being used for official business. A Fox News source told Catherine Herridge, the network's chief intelligence correspondent, that it was "no coincidence" Lazar was extradited. Ron Hosko, the former assistant director of the FBI's Criminal Investigative Division from 2012-2014, concurred. "Because of the proximity to Sidney Blumenthal and the activity involving Hillary's emails, (the timing) seems to be something beyond curious," Hosko said, the network reported Friday. Lazar, 44, appeared in an Alexandria, Virginia, federal courtroom for a detention hearing on Tuesday. He is expected to be in the U.S. for 18 months. He was previously serving out a seven-year prison sentence for hacking crimes in Arad, Romania. "I used to read (Clinton's) memos for six or seven hours ... and then do the gardening," Lazar told a Romanian reporter during a 2015 interview, Fox reported. The conservative website Hotair noted Friday that Lazar's hacking makes it hard to imagine the FBI not prosecuting Clinton for violations of 18 U.S. Code 793, which covers rules on gathering, transmitting or losing defense information. It states:
"This development, if it pans out, points directly at Hillary herself. It was her server; it was in her possession; and she deliberately chose to evade the law and the security provided by the U.S. government for classified information and its transmission," Hotair's Ed Morrissey concluded. Complicating matters for Clinton is her signature on a Sensitive Compartmented Information Nondisclosure Agreement she signed after becoming secretary of state. The document placed the onus on her to recognize sensitive intelligence. "I understand that it is my responsibility to consult with appropriate management authorities in the Department ... in order to ensure that I know whether information or material within my knowledge or control that I have reason to believe might be SCI," the agreement said, the Washington Free Beacon reported Nov. 6, 2015. "There is not even the remotest chance that is going to happen," Clinton said. "But look, (Republicans have) been after me, as I say, for 25 years. And they have said things about me repeatedly that have been proven to be not only false but kind of ridiculous." FBI agents assigned to the investigation are also trying to determine whether co-mingling of the Clinton Foundation and State Department business violated public corruption laws. Bryan Pagliano, a State Department employee who helped set up and manage Clinton's server, was given immunity from prosecution by the agency. |

Is The Noose Tightening Around Hillary?
If nominated, Clinton may have to campaign in handcuffs in the general election
If Hillary Clinton manages to become the Democratic presidential nominee, she’ll likely be forced to juggle campaigning for the general election with an indictment for her handling of sensitive government emails as Secretary of State.
That’s according to former FBI officials who say the agency will likely decide whether Clinton and her top aids will face charges just as the general election heats up.
“I don’t know that there’s any magical cutoff date,” Ron Hosko, the FBI’s former assistant director of the criminal investigative division, told The Hill of the likelihood that charges could come during the general election.
Clinton has been under investigation for the past six months. And the agency has made no secret that it isn’t taking the investigation lightly.
Former FBI agent Timothy Gill explained how the agency is using the law to pursue charges against Clinton in a November interview withFox News, saying: “This is a broad, brush statute that punishes individuals who are not direct and fulsome in their answers.
“It is a cover-all. The problem for a defendant is when their statements cause the bureau to expend more time, energy, resources to de-conflict their statements with the evidence,” he said.
Around the same time, an agency source told Fox that investigators are “busting ass” to determine whether the former top diplomat is guilty of covering up her “gross negligence” in handling sensitive national security matters via an unsecured email account.
And in a more recent interview with Newsmax TV, former U.S. House Majority leader Tom DeLay said his sources in the agency are saying a Clinton indictment is inevitable.
“They’re ready to recommend an indictment and they also say that if the attorney general does not indict, they’re going public,” he said.
Fox legal expert Judge Andrew Napolitano also contends that Clinton’s actions will soon catch up with her.
“It seems that every week, more information comes to light about Clinton’s grave legal woes. Her worries are in two broad categories: One is her well-documented failure to safeguard state secrets and the other is her probable use of her position as secretary of state to advance financially her husband’s charitable foundation,” he said.
Napolitano has also said it would be “hard to believe” the FBI can avoid indicting Clinton.

As Democratic presidential candidate Hillary Clinton tries to put questions about her private email server to rest, Politico reports that the FBI has stepped up inquiries into the security of the former Secretary of State's server as well as the communication between aides.
"This sounds to me like it's more than a preliminary inquiry; it sounds like a full-blown investigation," said Tom Fuentes, former assistant director of the FBI. "When you have this amount of resources going into it …. I think it's at the investigative level."
Though the FBI has declined to comment on their examination, Politico reports that the agency has interviewed insignificant individuals who corresponded with Clinton in an attempt to determine the security of the sever.
According to former FBI and Justice officials, the agency is tasked with trying to prove two things: "whether the use of an outside email system posed any risks to national security secrets and if so, if anyone was responsible for exposing classified information."
Politico notes that it is unclear who the FBI is talking to at the staff level, however, Clinton's campaign and lawyers are cooperating.
Not only are they turning over Clinton's server and a thumb drive backup of her messages to the FBI, but they are also encouraging anyone who has been affiliated with the server issue to do the same.
While the FBI continues to step up their inquiries, the agency is not obligated to announce if they take the preliminary inquiry into a full-fledged investigation. And, currently, the secrecy surrounding the FBI's investigation makes it impossible to know where the FBI stands on the issue.

However, Hosko added that in such investigations it is "not uncommon" for companies to require subpoenas, court orders or other legal notices to cooperate to save their corporate reputation, Politico reports.
Hosko added, "I am sure there is hand-wringing and gnashing of teeth across the street at the Hoover Building because you're going to have people saying ‘I don't want to produce X documents. Give me a piece of paper that covers me.' And that's where push is going to come to shove."
