Judge rules that Broward Co. officials broke the law by destroying ballots in Wasserman Schultz race

A Florida state circuit judge ruled Friday that Broward County elections supervisor Brenda Snipes broke the law and illegally destroyed ballots cast in the 2016 Democratic primary for the seat held by former Democratic National Committee Chair Rep. Debbie Wasserman Schultz.

What’s the background?

Wasserman Schultz, whose tenure as DNC chair was marred by accusations that she used the DNC to tip the scales in the presidential primary in favor of eventual nominee Hillary Clinton, faced a primary challenge in 2016 from law professor Tim Canova. Wasserman Schultz won the primary by a relatively comfortable margin of 56 percent to 43 percent, or a total of almost 7,000 votes.
However, as Politico reports, a documentary filmmaker posted a blog post in October 2016 that purported to demonstrate voting irregularities in the primary results. Canova made a public records request in March 2017 to review the ballots, according to the court’s ruling, and subsequently filed suit in June 2017. Due to a technical deficiency in Canova’s original complaint, the court dismissed it but allowed him to file an amended complaint, which he did on Oct. 19.
According to the court’s ruling, Canova filed a motion for contempt against Snipes for failure to produce the paper ballots, as required by state law. During a Nov. 6 hearing on this motion, Snipes admitted that the paper ballots had been destroyed, in spite of the fact that Florida law requires the ballots to be kept for at least 22 months after an election and in spite of the fact that litigation concerning the ballots was pending before the court.
Canova then filed a motion for summary judgment, asking the court to rule that Snipes’ destruction of the ballots was illegal as a matter of law. Snipes responded that since she contends that the destruction of the ballots was unintentional and since she made copies of the paper ballots, no violation of Florida law had occurred.
The court disagreed. In its ruling, the court stated: “The constitution grants every person the fundamental right to inspect or copy public records. … Defendant’s lack of intent to destroy evidence while this case was pending is irrelevant.”
The court also rejected Snipes’ argument that Canova’s records requests were “unreasonable.”
As a result of the court’s ruling, the county will be responsible for Canova’s legal fees, which are estimated to be in excess of $200,000, according to Politico.

What happens now?

Canova has called upon Florida Gov. Rick Scott (R) to dismiss Snipes for “malfeasance and misfeasance.”
Scott’s office has not yet committed to a course of action against Snipes. According to a statement provided to Politico, Scott plans to review the case and the judge’s ruling before making a decision.
In the meantime, Canova is once again challenging Wasserman Schultz at the ballot box, but this time he is running as an independent.

House Minority Leader Nancy Pelosi (D-Calif.) issued a surprising warning for those attending President Trump’s State of the Union speech Tuesday – but it was Democrats, not Republicans.
Here’s what she said:
Fox News’ Chad Pergram reported that Pelosi delivered a “stern warning” to Democrats that were to attend the speech. “Play nice,” his tweet said.
He added that Pelosi didn’t want a repeat of the outburst during former President Barack Obama’s address to Congress where a Republican yelled “you lie!” after he claimed Obamacare would never provide healthcare for illegal aliens.
Pergram also said that Pelosi told Democrats to not attend the speech if they were planning to walk out in protest. She is quoted as saying they should allow Trump to be his “slobbering self.”
“If you want to walk out, don’t come in,” she said, according to a report in Politico.
Pelosi reportedly told Democrats at the meeting that there were such lowered expectations for Trump that he could do nearly anything and call it a success. “If his nose isn’t running and he isn’t burping, he did a great speech,” she reportedly remarked.
Several Democrats said they will boycott the speech, while Supreme Court Justice Ruth Bader Ginsberg will also skip the speech in favor of a previously planned speech she is scheduled to give.

FBI and DOJ are being formally investigated by House Intel Committee, top House Democrat announces

The House Intelligence Committee is officially investigating the Department of Justice and FBI, the committee’s ranking Democrat confirmed during a news conference Tuesday.

What did he say?

Rep. Adam Schiff (D-Calif.) told reporters at a lengthy press conference that Monday was the first time the committee’s Republican majority informed the Democratic minority of the investigation.
Schiff’s comments came shortly after the House Intelligence Committee voted to release the controversial “FISA memo,” which allegedly details government surveillance abuses. Schiff explained:
It was disclosed to the minority today for the first time that the majority has evidently opened an investigation of the FBI and an investigation of the Department of Justice. Under our committee rules, of course, that has to be the product of consultation with the minority.
Now it has been publicly reported from time to time that there was a subset of the majority working on some kind of an investigation or inquiry into the Department of Justice and FBI. But apparently the chairman [Rep. Devin Nunes (R-Calif.) made it formal today.
According to [Republicans], the FBI is under investigation and so is the Department of Justice.
Schiff later called the investigations a “wholesale broadside” against the DOJ and FBI, according to the Washington Examiner, but he didn’t specify why the committee is investigating.

Why might there be an investigation?

Increased scrutiny has been building around the DOJ and FBI in recent weeks as more information comes out detailing how the agencies handled both the Clinton email investigation and the investigation into Russian interference in the 2016 election, which has effectively become the Trump-Russia investigation.
Lawmakers are also concerned that the Obama administration, via the DOJ and FBI, improperly secured a surveillance warrant from the Foreign Intelligence Surveillance Court for a Trump campaign official by using information from the unverified “Trump dossier.”
Evidence that the FISA warrant was issued based upon the salacious document is reportedly detailed in the “FISA memo” created by a handful of members on the House Intelligence Committee. The report is the product of thousands of DOJ documents, Rep. Trey Gowdy (R-S.C.) told Fox News over the weekend.

But is the investigation new?

While Schiff announced the investigation is officially formal, a Nunes spokesperson told the Exmainer that Nunes discussed the inquiry on Fox News last month.
In addition, Politico reported last month that a small group of Republicans on the House Intelligence Committee were investigating the DOJ and FBI. According to the report, the group is probing for corruption and how the agencies used the dossier.

de Blasio Has An Overblown Opinion Of HImself

New York City Mayor Bill de Blasio seems to believe he is destined for great things. He even traveled to Iowa earlier this month, and although he's flatly denied that he is eyeing a run for president, the mayor has signaled in interviews that his sights are set on much more than just his city.
There's just one problem — many Democrats have no interest in seeing him run. "They think he's smug," Politico writes, adding: "The rap on de Blasio is that he likes to make a lot of noise but doesn't like to do a lot of work, that he has an oversize sense of his own importance."
De Blasio doesn't do much to help his case in that regard. Confronted with his bold failure of a "progressive agenda" that he initially announced in 2014, de Blasio called it "banal and simplistic" to suggest he might fail again if he takes the plan national:
“I want to talk to anyone who thinks that and tell them they need to start thinking more. I mean, give me a break. So every time someone tries something and it doesn't work, it invalidates anything else they might do going forward? Tell Thomas Edison that, and Henry Ford, tell Mahatma Gandhi. How many people fell on their faces along the way trying things, experimenting with things, had setbacks? There's no leader who hasn't had setbacks."
Perhaps realizing the folly of comparing himself to such giants of history, de Blasio swiftly corrects himself — he's a "speck on the universe" compared to those three, just trying to do his part. But ask him about Hillary Clinton, whose 2000 Senate campaign he managed but whose 2016 presidential campaign he was banished from because he slammed her for failing to have a progressive vision, and he'll jump in with, "But I was right!" Report: Tillerson Erupts During White House Meeting

Secretary of State Rex Tillerson reportedly took out his frustrations on a White House aide Friday after experiencing delays in getting his appointments for State Department positions approved. 
Tillerson erupted on Johnny DeStefano, the head of the presidential personnel office, because the White House has denied several of Tillerson’s appointments, in addition to questioning his judgement, Politico reported.
An unnamed source also told Politico that Tillerson accused the White House of leaking potentially damaging information about him to the press.

The secretary of state said that he didn’t want DeStefano’s office to “have any role in staffing” and “expressed frustration that anybody would know better” than him about which individuals would be appropriate to work in his department, according to the source.
The former Exxon CEO’s frustration also stemmed from the fact that President Donald Trump reportedly promised him the autonomy to decide for himself who would be on his staff.
The outburst occurred in the office of White House chief of staff Reince Priebus, but other members of the Trump administration were present as well, including senior adviser to the president Jared Kushner and Tillerson’s chief of staff Margaret Peterlin. 

Kushner later told Peterlin that Tillerson’s outburst was unprofessional and that a solution was needed to resolve the issue.
“Colleagues are capable of frank exchanges,” State Department spokesman R.C. Hammond told Politico.
“Evaluating nominees did get off to a slow start, but it is now moving along at a pretty good clip,” he said.



A close associate of Rex Tillerson told Mark Perry of The American Conservative that Tillerson is upset because the White House and State Department do not appear to be on the same page.
This is especially so regarding the Middle East situation, the associate claimed, where Kushner is “running a second foreign policy out of the White House family quarters.”
“Rex is just exhausted. He can’t get any of his appointments approved and is running around the world cleaning up after a president whose primary foreign policy adviser is a 36-year-old amateur,” the associate said.
