COULD A LAWSUIT AGAINST THE IRS DERAIL OBAMACARE?
Beyond the scandal that rocked Washington this week involving targeting organizations based on their political leanings, the Internal Revenue Service faces additional troubles, as an unnamed healthcare provider in California is suing the IRS and 15 unnamed agents, alleging they improperly seized 60 million records of 10 million Americans — including the medical records of all of California’s state judges.
“This is an action involving the corruption and abuse of power by several Internal Revenue Service agents,” the complaint reads.
“No search warrant authorized the seizure of these records; no subpoena authorized the seizure of these records; none of the 10,000,000 Americans were under any kind of known criminal or civil investigation and their medical records had no relevance whatsoever to the IRS search.”
This lawsuit is expected to present an issue for President Barack Obama’s health care law, which relies on the IRS to enforce the individual mandate and administer tax credits. Republicans are using this lawsuit as an example as to why we need to repeal the mandate and dismantle Obamacare as it puts too much importance on the relationship between healthcare and the IRS.
ABC News reports that Sen. John Cornyn of Texas has introduced a bill called the “Keep the IRS Off Your Health Care Act of 2013,” which would prohibit the Secretary of the Treasury, or any delegate, including the IRS, from enforcing the Affordable Care Act.
“Now more than ever, we need to prevent the IRS from having any role in Americans’ health care,” Cornyn said. “I do not support Obamacare, and after the events of last week, I cannot support giving the IRS any more responsibility or taxpayer dollars to implement a broken law.”
