A federal judge has vindicated the plight of Tea Party groups persecuted by the IRS with the preliminary approval of a $3.5 million settlement. (U.S. News & World Report)

U.S. District Judge Michael Barrett set a July 10 hearing in Cincinnati on making the settlement final, and scheduled deadlines for claims and objections.

The Justice Department had announced last year that the case had been settled, pending approval of terms.

The lead plaintiff was the California-based Norcal Tea Party Patriots. The case swelled into a class-action suit by hundreds of groups. The court will decide how much each gets after legal costs.

The 2013 lawsuit during the Barack Obama administration was over treatment of conservative groups who said they were singled out for extra IRS scrutiny on tax-exempt status applications.

The case hounded the Obama administration for years, with many Republicans discouraged that stronger action wasn't taken.

On Wednesday night, President Trump bamboozled and frustrated Democrats
once again with a barnstorming campaign speech in Iowa. There, he trotted out
his litany of complaints about the media, rightly ripping them for their ridiculously
over-the-top coverage, and tossed off one-liners about a solar panel border wall
and cutting off welfare for immigrants (already federal policy).

But here’s the bottom line: Trump is best on the trail. It drives his political
opponents up a wall, forces the media into fact-checking extremis, and makes
 him feel good about himself – which is important, since when he feels down
 and blue, he takes to Twitter to fire off foolishly counterproductive tweets.

There are those of us who would like to see Trump out on the campaign trail
continuously, all the while delegating the technical parts of his job to Vice
President Mike Pence and his cabinet. We'd like to see Trump run the White
House the way he ran his business: as a branding enterprise for Trump, while
 someone else does the heavy lifting.

But that may not be the best political outcome for Trump. The political outcome
for Trump might lie in getting nothing done.

That's not a rip on Trump. That's a rip on our politically polarized country.

The entire Democratic narrative now rests on the evils of President Trump.
With their Trump-Russia collusion story falling apart from every angle, Democrats
 will have to turn to portraying Trump as a cruel threat to liberty, a dastard intent
 on doing ill to Americans across the country. But it’s difficult to make that case
 when nothing is getting done.

And right now, nothing is getting done. Even the much-vaunted Obamacare
 “repeal” doesn’t repeal Obamacare. Tax reform isn’t going to be a winning
issue for Democrats, since raising taxes never is. Trump’s border wall has
been stalled since Day 1, and he just re-enshrined Obama’s executive amnesty.
On foreign policy, Trump has avoided major disaster thus far, muddling through
with an ad hoc strategy.

All of which deprives Democrats of a rallying point.

In order to make major gains in an off-year election, typically the party out of
power needs two things: an unpopular president, and a galvanizing piece of
 legislation. President Obama provided both – his Obamacare proposals, his
auto takeover, his massive stimulus boondoggle – all of it combined to catalyze
 the Tea Party into existence. In 1994, Bill Clinton’s scandals, combined with
 his push for nationalized health care, did the same for Republicans.

But what if Trump doesn’t actually pass any major legislation? What if nothing
gets done? Democrats will be hard-pressed to say they require the House to
 impeach Trump if Trump is no threat – and meanwhile, Trump goes around the
 country preaching to the converted, getting them out to the polls in order to
protect the precious. Inaction from the Trump administration could actually
fulfill one of the first rules of political war: never interrupt your opponent when
 they are making a mistake. And Democrats can't stop making mistakes.

This creates a perverse set of incentives for the Trump administration: if they
 get nothing done, they can blame Democrats and also avoid portrayal as a
supreme threat to the Democratic way of life; they can even point to their few
victories as massive roadblocks to the leftist agenda (see Gorsuch, Neil). If they
 get something major done, they’ll likely tick off half of Republicans and could
 actually create a rallying point for the left.

So inaction may be the order of the day. And that could actually prevent
 Democrats from using Trump to unite the #Resistance.

Scientists Finally Agree on the Best Way to Quit Smoking

The Tea Party was a turning point in American politics. After Establishment

 Republicans and Democrats came together to rob the American taxpayers

 blind with big corporate bailouts, and the Obama administration passed

 Obamacare, millions of Americans rose up, demanding limited government

 and a return to accountable democracy. They got it. 

Now angry liberals are trying to hold their own Tea Party, and they're off to a

horrific start. How bad is it? Well, I'll let Guy Benson explain:

Americans have a right to show up, and speak up, in public meetings with

their elected representatives. That civic principle applies to the anti-Trump

"resistance" just as much as it applied to the Tea Party. Americans also

 have a right to judge their fellow citizens' comportment and approach to

influencing the political process. The Left is organizing to swarm forums

held by Republican members of Congress, several of whom have

 demonstrated constructive methods of dealing with unruly and hostile

crowds.  The resulting confrontations are churning out made-for-television

moments for which the media has a bottomless appetite -- especially since

these aggrieved citizens are on the "good" side of things, unlike the

unseemly hoards in 2009 and 2010.  But here's what the sanitized and

curated evening news soundbytes aren't likely to show: In Louisiana on

Wednesday, Sen. Bill Cassidy hosted a town hall meeting to discuss

various policies, including Obamacare. The organized Left showed up

in full throat, behaving boorishly before the Senator even took to the

podium. They shouted and heckled throughout a pastor's opening prayer,

then many refused to stand or even maintain any semblance of decorum

during the pledge of allegiance, which was led by a local veteran. Deplorable:

These people are out of their minds. As Benson notes, they're also ignorant:

The rude, furious screeching of "separation of church and state!" betrays an

embarrassing ignorance of American history. Our founding document guards

against the intertwining of religion and governance by prohibiting the

establishment of a national religion, but the notion that a public prayer prior

to a gathering like this somehow violates the constitution is ludicrous. In fact,

the legislative body in which Sen. Cassidy serves opens each daily session 

with a prayer from its appointed in-house chaplain.  But the angriest shouters

weren't interested in facts or perspective, as their frenzied tantrums then

carried on through the pledge of allegiance.  One of their grievance themes

 is that Cassidy is a mean-spirited demon who wants to rip healthcare away

from innocent children. 

The Tea Party didn't succeed because it was well organized and well funded. 

It succeeded because it stood up for the interests of ordinary Americans.

 Unless liberals are willing to accept the diverse religious beliefs and interests

 of people on main street, they'll never make any headway. 

The long and short of it is this: Liberals dug a big hole the last eight years, and 

instead of trying to climb out, they're calling in the earth movers.

WASHINGTON — President Trump on Tuesday nominated Judge Neil M. Gorsuch, a federal appeals court judge in Denver, to fill the Supreme Court seat left open by the death of Justice Antonin Scalia, elevating a jurist whose conservative bent and originalist philosophy fit the mold of the man he would succeed.

Mr. Trump’s announcement, delivered during prime time in the East Room of the White House, marked his first bid to reshape the nation’s highest court.

It presaged a bitter political battle on Capitol Hill, where Democrats in the Senate, still stung by the Republican refusal to confirm President Barack Obama’s nominee for the seat, Judge Merrick B. Garland, have promised stiff resistance.

If confirmed, Judge Gorsuch would restore the 5-to-4 split between liberals and conservatives on the court, handing Justice Anthony M. Kennedy, 80, who votes with both blocs, the swing vote.

At 49, Judge Gorsuch is the youngest nominee to the Supreme Court in 25 years, underscoring his potential to shape major decisions for decades to come. In choosing him, Mr. Trump reached for a reliably conservative figure in the Scalia tradition but not someone known to be divisive.

A Colorado native who was in the same class at Harvard Law School as Mr. Obama, Judge Gorsuch is known for his well-written, measured opinions that are normally, though not exclusively, conservative. He holds a Ph.D. from Oxford University, where he was a Marshall Scholar, and a pedigree as a law clerk at the Supreme Court to Justices Byron R. White and Kennedy. President George W. Bush nominated Judge Gorsuch to the federal bench in 2006.

Judge Gorsuch’s personal connections to Justice Kennedy are no accident. By choosing a familiar figure, several officials said, the White House is sending a reassuring signal to Justice Kennedy, 80, who has been mulling retirement.

Choosing a more ideologically extreme candidate, the officials said, could tempt Justice Kennedy to hang on to his seat for several more years, depriving Mr. Trump of another seat to fill.

Still, Judge Gorsuch’s conservative credentials are not in doubt. He has voted in favor of employers, including Hobby Lobby, who invoked religious objections for refusing to provide some forms of contraception coverage to their female workers. And he has criticized liberals for turning to the courts rather than the legislature to achieve their policy goals.

There had been speculation that Mr. Trump would choose someone with a less elite background for the court. The other finalist for the post, Judge Thomas M. Hardiman, was the first person in his family to graduate from college, and helped pay for his education by driving a taxi.

Judge Gorsuch, on the other hand, is the son of Anne Gorsuch Burford, who became the first female head of the Environmental Protection Agency under President Ronald Reagan. He attended Georgetown Preparatory School, outside Washington, before going to Columbia University.

Democrats, who declined invitations from Mr. Trump to attend the White House announcement ceremony, seemed unlikely to be satisfied with Mr. Trump’s choice. Senator Chuck Schumer of New York, the Democratic leader, has said he is ready to block any candidate he sees as outside the mainstream, a stance that could touch off a Senate showdown in which Mr. Trump is already urging Republicans to change longstanding rules and push through his nominee on a simple majority vote.

Judge Gorsuch will need to draw the support of eight Democrats to join the 52 Republicans in the Senate to surmount a filibuster and move forward with an up-or-down confirmation vote.

Progressive groups were already planning a rally in front of the court on Tuesday night, anticipating an “extreme” nominee.

“Activists will make clear that the Senate cannot confirm a nominee who will simply be a rubber stamp for President Trump’s anticonstitutional efforts that betray American values,” according to a statement from the organizations, which include People for the American Way, the Leadership Conference on Civil and Human Rights and Naral Pro-Choice America.

Conservative groups, too, were planning a major push to defend Mr. Trump’s nominee. Within minutes of the president’s announcement, organizers said, the Judicial Crisis Network was to begin the first phase in a $10 million television advertising campaign on the nominee’s behalf, along with a website promoting Mr. Trump’s pick. More than 50 groups were backing the effort, including gun rights and anti-abortion rights activists and the Tea Party.
