President orders halt to last-minute Obama regulations

President Donald Trump issued a presidential memorandum Friday ordering federal departments and agencies to freeze all regulations — new and pending — until his administration has had a chance to review them.
The action is standard for any incoming presidential administration seeking to reverse or review the policies of the previous administration. President Barack Obama in 2009 issued a similar memorandum to halt any new and pending regulations that were announced under President George W. Bush.
Barring matters of health, safety, financial or national security, the presidential memorandum directed the heads of all federal departments and agencies to halt any new or pending regulations until someone appointed by Trump can review and approve them. For regulations that have already been published in the Federal Register but that have not yet taken effect, the memorandum postpones the effective date by 60 days from Jan. 21, the day the memorandum was issued.
Because the memorandum was widely anticipated, Obama officials rammed through a series of new regulations between Election Day and the inauguration, hopeful that perhaps some of their last-minute actions would slip by the Trump transition team and still take effect.
Gina McCarthy,, EPA administrator under former President Barack Obama, offered a candid glimpse into what may have been the outgoing administration’s intent. According to Politico, McCarthy sent a letter Nov. 9 to agency employees, saying, “We’re running — not walking — through the finish line of President Obama’s presidency.”
Among the Obama regulations that could be affected are tightened rules on how some fossil fuels can be transported, as well as tougher requirements for entrepreneurial immigrants looking to stay in the U.S.
Trump cannot reverse any regulations that have already taken effect. That would, in most cases, require an act of Congress repealing the legislation that allowed the regulation to be issued in the first place. For example, Congress would need to either repeal or defund the Dodd-Frank Act in order to reverse any substantive Wall Street regulations.

We’ve written here previously about the draconian restrictions the EPA is quietly implementing in our nation. In fact WE were skewered by the liberal media for mentioning barbecue grills.
Well, hate to say we told you so, but it’s about to get even more absurd. And once again, it goes right the heart of something most Americans treasure.
Per the Daily Caller, enjoy Independence Day while you still can. If President Obama gets his way, this could be the last Fourth of July worth celebrating.
New ground-level ozone standards being pushed by Obama and the Environmental Protection Agency would result in widespread bans on fireworks shows, backyard grilling and other Independence Day traditions.

Because the proposed ozone rule is set so low, things as harmless as a few backyard chefs grilling burgers in the same area at the same time, or even festive fireworks being launched during an Independence Day celebration, could cause an area to violate federal ozone standard thresholds. Such a violation of the EPA’s unreasonably low ozone limit would result in fines and other penalties for local governments from federal regulators.
In an attempt to steer clear of punishment, local lawmakers will have to respond to the new EPA rules by enacting municipal grilling bans and canceling fireworks shows from sea to shining sea.
Yep, another one of those great ideas that will increase prices of goods sold, eliminate jobs and once again, assault one of our most cherished traditions.
Recent studies by the National Association of Manufacturers and other groups have shown that the EPA’s new directive would be the most expensive regulation ever enacted, costing the economy $140 billion annually. Even the EPA’s own cost estimates acknowledge the economic hit from the proposed regulation would be well into the tens of billions of dollars a year
Oh, and here’s the best part of all. Despite the damage this will do to our economy and American way of life, it will do almost NOTHING to improve air quality, reducing ozone to a level barely above naturally occurring levels.
Excuse me for a moment. HAHAHAHAHAHA.
Okay. I’m better now.
Even the EPA doesn’t really understand why the rule is needed. While testifying before Congress earlier this year, EPA Administrator Gina McCarthy indicated that ozone levels would go down without this rule in place.
My friends, we are frogs in that pot of water and the temperature is ever so slowly being turned up, almost imperceptibly. As the Daily Caller says, this new guideline will make it so difficult to comply, whole regions of the country will have to pay fines and face other penalties, without any realistic hope of meeting the standard short of banning cars and forcing businesses to close.
Enjoy your smoke-belching pick-up with the gun rack and the American flag waving off the railing while you can folks, because don’t think for a second they’re not ALL in Obama’s sights.
I am personally astonished by the speed in which he is destroying this nation and our deeply-held fundamental beliefs and traditions. It is the now the final act in the tragic drama of the Obama presidency and we haven’t even seen the grande finale.

EPA Administrator Gina McCarthy said Monday during a White House summit on global warming that "climate deniers" are not normal humans.

According to The Daily Caller, McCarthy addressed a group of doctors, health professionals, and others about why the EPA feels climate change is a public health issue.

"I am doing that not to push back on climate deniers," McCarthy said, reports The Daily Caller, alluding to the EPA's practice of releasing reports to inform the public about climate change. "You can have fun doing that if you want, but I've batted my head against the wall too many times and if the science already hasn't changed their mind it never will.

"But in any democracy, it's not them that carries the day. It is normal human beings that haven't put their stake into politics above science. It's normal human beings that want us to do the right thing, and we will if you help us."

According to The Hill, McCarthy made the case that climate change is "the biggest public health challenge of our time."

Ahead of McCarthy's remarks, the White House released an action plan for dealing with climate change, which includes multiple federal agencies, reports The Hill. 

The 2015 Lancet Commission on Health and Climate Change, meanwhile, released a report in the medical journal The Lancet detailing its findings about climate change and how it relates to public health.

"Climate change is a medical emergency," commission co-chair Professor Hugh Montgomery said in a press release, according to Discovery. "It thus demands an emergency response, using the technologies available right now."

On Monday, it was reported that the White House has asked the Pentagon to measure the amount of ice in the Arctic.

The Obama administration argued that a decreased amount of ice in the Arctic could lead to a greater military presence there.

"Difficulty in developing accurate sea ice models, variability in the Arctic's climate, and the uncertain rate of activity in the region create challenges for DOD to balance the risk of having inadequate capabilities or insufficient capacity when required to operate in the region with the cost of making premature or unnecessary investments," a recent study from the Government Accountability Office reads.

"DOD plans to mitigate this risk by monitoring the changing Arctic conditions to determine the appropriate timing for capability investments."

Sen. Jeff Sessions, R-Ala., went head-to-head with Environmental Protection Agency’s Gina McCarthy during a recent congressional hearing on climate change, ultimately telling the federal bureaucrat: It’s unbelievable you can’t guarantee if models have been accurate.
The Senate Environment and Public Works Committee hearing started tamely enough, with Sessions questioning the EPA’s request for a budget increase of 6 percent.
“I mean, where does the money come from?” he asked, a YouTube video of the exchange showed.
Sessions then raised the point that plenty of his constituents complain about the EPA’s “extraordinary overreach” and that he’d like McCarthy to address statistics on droughts, hurricanes and other weather events cited as evidence of climate change.
“I’m not inclined to increase your funding,” he said. “So now you say we’ve got a crisis and a danger out there. … [Yet a scientist found] we’ve had fewer droughts in recent years. Do you dispute that?”
But McCarthy couldn’t specify, AL.com reported.
“I don’t know in what context [a scientist] is in making statements like that,” she said.
An obviously frustrated Sessions jumped in and said, “Well, you need to know because you’re asking this economy to sustain tremendous costs,” the video showed.
McCarthy gave similar shoulder shrugs to other weather-related questions.
On hurricanes, McCarthy said: “I cannot answer that question. It’s a very complicated issue,” AL.com reported.
And on temperature, she said: “I do not know what the [temperature] models actually are predicting that you are referring to.”
Sessions ultimately asked: “Is the temperature increasing less than [models predict] or more than that?”
McCarthy’s reply?
“I cannot answer that,” the video showed.
Sessions was shocked.
“This is a stunning development, that the head of the Environmental Protection Agency – who should know more than anybody else in the world, who is imposing hundreds of billions of dollars in cost to prevent this climate temperature increase – doesn’t know whether their projections have been right or wrong,” Sessions said, AL.com reported.

The IRS isn't the only government agency that has lost emails that the House Oversight Committee wants to see as part of an investigation — now the Environmental Protection Agency said it is missing emails as well.

"I don't believe this is a missing hard drive issue," EPA Administrator Gina McCarthy told the Republican-led committee on Wednesday, CNN reported.  "There is a challenge getting access to the data on it ... I'm still hoping we recover all those emails."

Her admission came just as the committee was focusing on the Internal Revenue Service's contention that the hard drive on a computer used by former official Lois Lerner had been destroyed after it crashed, losing emails that Oversight says are crucial in its investigation into whether the agency improperly targeted conservative groups for extra scrutiny.

The missing EPA emails belong to a biologist who had worked on a controversial mining project assessment for the Pebble Mine in Alaska. The Oversight Committee and the EPA's own inspector general are conducting separate investigations into whether the biologist or the EPA colluded with environmentalists on a negative review of the Alaskan project.

The EPA froze the permitting process for the mine after a review showed it could harm a nearby sockeye salmon fishery in Bristol Bay.

McCarthy's news about the missing emails was met with disapproval from Oversight Committee members.

"I heard similar testimony yesterday," Republican Rep. Mark Meadows of North Carolina told her, referring to Tuesday's hearing about the missing Lerner emails.

Lerner's computer crashed in June 2011, according to IRS officials, resulting in the loss of records that are sought in investigations into the agency's targeting of conservative and tea party groups seeking tax-exempt status. At the time, the agency tried to recover the records, but without success.

McCarthy said the biologist in the EPA investigation was not a decision-maker in the permitting process, but instead was hired to give input for the science assessment. Further, she said no decisions have been made on Pebble Mine's permit.

Meadows asked her if the agency broke federal laws on record-keeping and if the biologist's emails were preserved, and she said the EPA has notified the National Archives and Records Administration about the hard-drive issue.

Oversight Committee Chairman Darrell Issa, a California Republican, demanded the EPA turn over the documents, which were subpoenaed last year.

"I am telling you, the time to comply is now," Issa told her. "If it is not complied with ... this committee will consider and vote on contempt. I hope that over the next few days our folks and your folks can resolve this with all the emails."
