In court documents filed on Wednesday, attorney Allen Richards blasted "sad and sorry" President Donald Trump for calling his client, the man charged with the murder of 20-year-old Mollie Tibbetts, an illegal immigrant. According to Richards, Mexico native Cristhian Bahena Rivera, 24, was working at an Iowa dairy farm legally.
But Richards, according to authorities, is incorrect. Immigration officials say Rivera is indeed an illegal alien who was never in the E-Verify system, as has been falsely claimed.
In documents seeking a gag order, Richards accused the federal government, namely President Trump, of spreading the false information about his client's legal status. "Sad and sorry Trump has weighed in on this matter in national media which will poison the entire possible pool of jury members," wrote the attorney.
On Trump's personal account and the White House's official Twitter account, Rivera was identified as an "illegal alien" and used as an example of America's broken immigration laws:
As reported by the Des Moines Register, Rivera lived in Iowa for years and worked at Yarrabee Farms, the owners of which include prominent Republican Craig Lang. According to Richards' motion, Lang had verified that Rivera was in Iowa legally. One day before the motion was filed, Yarrabee Farms, via a statement, said Rivera was vetted through the E-Verify system.
"Craig Lang supports Cristhian’s right to be in this jurisdiction and for the government to support any other idea of status publicly flies in the face of such statement," claimed Richard, adding, "Cristhian deserves the court’s protection as to his characterization before a jury pool."
This, however, turned out to be false: Rivera was never in the E-Verify system. "A government archive does not indicate the Brooklyn, Iowa, farm as a participating member of the system," notes the Des Moines Register. Yarrabee Farms acknowledged this reality on Wednesday.
Additionally, Michael Bars, a spokesman for the U.S. Citizenship and Immigration Services told USA TODAY, "A search of records by USCIS revealed Rivera did not make any DACA requests nor were any grants given. We have found no record in our systems indicating he has any lawful immigration status."
The gag order request by Richards was denied by a Poweshiek District Court Judge.

California AG Threatens Officials for Upholding Federal Immigration Law

California attorney general Xavier Becerra threatened to arrest Orange County Sheriff Sandra Hutchins for doing her job by upholding federal immigration laws.

“You are chief law enforcement officer of the county. The attorney general is threatening to arrest you,” Fox News host Tucker Carlson said to Hutchins. “I have never heard of anything like that happening in any state.”

Carlson was outraged that the California attorney general would rather arrest a law enforcement officer doing her job than rid the state of illegal immigrants who are breaking federal law by being in the United States unlawfully.

The brouhaha erupted after the Orange County board voted to join the Trump Administration’s lawsuit against California’s sanctuary state law. Specifically, the sheriff’s department said it will publish a list of inmate release dates, in defiance of California’s sanctuary state law that discourages local law enforcement from helping federal immigration authorities.

Federal Government Attacks Small Business Owner for Refusing to Hire Illegals

The Department of Justice sued an American business for doing the 
unthinkable: Ensuring that their employees are legally permitted to work 
in the United States. As the Daily Caller reports:
A Florida pizzeria agreed to pay a hefty court sum for asking immigrants

 to provide a specific document proving their legal status, in a settlement

with the Department of Justice announced Tuesday.

Pizzerias LLC will pay the government $140,000 to resolve the dispute

over the way the chain tried to verify whether potential hires have legal

residence in the United States. The Justice Department was investigating

 whether the chain violated a federal law prohibiting employers from

making unnecessary demands for documents from people based

on citizenship.

The franchise, with more than 30 locations in Miami, was accused of

routinely asking lawful permanent residents for a Permanent Resident

Card to prove their work authorization, although they often have access

to the same documents a U.S. citizen would provide to prove work

authorization. Federal investigators found the demand for a Permanent

Resident Card possibly constituted an illegal hurdle for the immigrants,

in violation of an anti-discrimination provision of the Immigration and

Nationality Act.

The Justice Department concluded there is “reasonable cause to

believe that [Pizzerias] engaged in a pattern or practice of unfair documentary practices,” the settlement agreement states.
This is what happens when political preferences taint the law. Last year
 same Justice Department that sued Pizzerias for discriminating against
 immigrants INCREASED the penalties for companies caught employing
 illegal immigrants. As Fox News reported at the time:
Under the interim final rule published Thursday in the Federal Register,

the minimum penalty imposed by the DOJ for the unlawful employment

of immigrants would rise from $375 to $539, while the maximum fine

would go from $3,200 to $4,313.

The changes stemmed from amendments in a 2015 budget bill that

overhauled the formula for increasing such civil penalties. 

Violators facing multiple charges also would be subject to a new

maximum penalty of $21,563 for hiring illegal immigrants.
So here's what it appears happened. Pizzerias, in an effort to comply
 with the law and avoid a maximum fine of 21,000 dollars, did everything
 in their power to comply with the law.  But because complying with the 
law is considered "racist," they'll now have to pay a fine nearly seven 
times larger. 

Is it any wonder why companies don't comply with our immigration laws?

The Obama administration is ordering Border Patrol agents to release illegal immigrants without making them appear in court or keeping track of their whereabouts, and it’s also dramatically rolling back aerial surveillance along the southern border, leading a senior congressman to suggest the public is unaware it is being “betrayed” by its commander in chief.
What’s sad is the people of the United States don’t recognize that they’re being betrayed by their own president and also betrayed by those people in the Congress and the Senate who have been going along with this amnesty program,” said Rep. Dana Rohrbacher, R-Calif., a leading voice against amnesty and for border enforcement.
On Thursday, reports emerged that the Obama administration was effectively telling U.S. Customs and Border Patrol agents to stand down and not process people entering the United States illegally. They further state that agents are told not to order illegals to appear at a deportation hearing and not make efforts to track them down inside the U.S.
“We might as well abolish our immigration laws altogether,” said National Border Patrol Council President Brandon Judd.
In addition, Gov. Greg Abbott, R-Texas, and Rep. Henry Cuellar, D-Texas, are imploring the Department of Homeland Security for an explanation for a 50 percent rollback in aerial surveillance of the Texas-Mexico border.
Rohrabacher told WND and Radio America he and fellow critics of Obama’s immigration policies are well past the point of outrage.
“This president has done so many things that are contrary to the interests of the safety and security and prosperity of the people of the United States that this is no surprise, especially in dealing with foreign entities, whether it’s Muslims overseas or whether it’s illegal immigrants coming in here from various countries. This is nothing new for this administration,” he said.
One of Rohrabacher’s top concerns is how Obama’s open-door policy could further weaken national security.
“He’s opening the door,” he said. “There’s not even going to be a guard on the door to watch who’s coming in. Do you think the radical Islamist terrorists that have declared war on our country and murder us at any chance, you think they don’t see this? They have already got a lot of people here.”
He continued, “What the president is doing is going to increase the level of criminals that are coming here from other countries and terrorists who come here specifically to hurt Americans and kill Americans.”

While Rohrabacher is clearly disgusted with Obama on this issue, he is adamant that blame can be spread throughout the two parties.
"Our president is supposed to be watching out for the people of the United States. Our president has decided that he will not do so. The Democratic Party needs to be held accountable for this. And the people in the Republican Party that have been going along with this open-borders, amnesty approach to immigration deserve to be held accountable as well," he said.
The congressman said he understands that people are desperate to escape crippling poverty and other problems in their native countries and even admires their determination to make a better life for their families, but he said compassion for their circumstances cannot supersede the well-being of the American people.
"That doesn't mean we're going to bring people in who will take jobs away from Americans, will consume the health care and the education dollars that we have for Americans," Rohrabacher said. "We don't need that."
He encourages voters to find out what their congressmen and senators have really been doing on these issues.
"Hold people accountable in public office for the stands they have taken," Rohrabacher said. "Our country is in grave jeopardy because of it."
He offers a couple of tips: "Look and see where your elected officials stand on amnesty. That's a tip-off as to whether they are secretly going along with the president."
Rohrabacher said one issue in particular gets twisted beyond recognition.
"How about those people who say we have to take care of the DREAMers? 'Oh, we have to take care of the DREAMers.' What they're talking about is giving benefits to young people who are here illegally when those education benefits should be going to our own people," he said. "Our own kids are saddled with debt, and we're going to give education benefits to people who have come here illegally?"
Since January 2015, Republicans have controlled both the House of Representatives and the Senate. So why can't the GOP do something to to curb Obama's alleged recklessness on the border?
"Controlling Capitol Hill doesn't mean anything unless you have a two-thirds vote against a president who vetoes anything he doesn't like," Rohrabacher explained. "It takes a two-thirds vote to override the veto, so we haven't been in control of Capitol Hill enough to be in control of a legislative agenda."
Rohrabacher has endorsed Ted Cruz for the 2016 Republican presidential nomination, in what seems like a process of elimination among the major candidates. He said Rubio is simply all over the map on this issue.
"The people of Florida elected him when he pledged not to support amnesty, pledged to fight this idea of open borders. As soon as he got elected to the United States Senate, he flipped over and became a major force for amnesty. Now he wants to flip again and wants us to forget that lie," Rohrabacher said.
The congressman simply doesn't believe Donald Trump is serious about the issue.
"Trump is talking off the top of his head and quite often he says things that are contradictory," Rohrabacher said. "He says we're going to deport the people here illegally. Then he says once they can get home, they can immediately come back if they want to. This is nonsense. So the only one who makes any sense to me is Ted Cruz."
